As we reported throughout this and last year, a number of natural health product seizures, criminal charges, and warning letters demonstrates that the U.S. Food and Drug Administration, (FDA) is upping it’s enforcement of existing dietary supplement regulations while efforts to dramatically expand them continue to be pushed from pharmaceutical companies within and commercial and political agendas outside the country. Efforts to “level the playing field” in favor of far less liberal and knowledgeable attitudes about natural health products; supplements, herbs and traditional medicines, continue through regulations and trade standards driven by pharmaceutical lobby, European political and UN committee influences.

The deadly E. coli in Europe was blamed on fresh organic vegetables. Warnings issued everywhere: “Don’t eat your vegetables!” This was followed with rather unseemly rapidity by food safety “experts” calling for the irradiation of fresh food, for more funding for the Food Safety Modernization Act (FSMA), and for a global food safety agency.

We disagree with FDA Codex delegate who said that people shouldn’t have truthful information about, for example, GMOs, so we don’t make what the FDA considers the “wrong” decision by refusing to buy GMOs.
We agree with the Supreme Court in the Western States case, where the High Court rejected the FDA position:
“If the First Amendment means anything, it means that regulating speech must be a last – not first – resort. *** We have previously rejected the notion that the Government has an interest in preventing the dissemination of truthful commercial information in order to prevent members of the public from making bad decisions with the information.” Thompson v. Western States Medical Center – April 29, 2002 – 535 U.S. 357
