There is so much going on right now… the attacks by the Powers that Be are, as Bill Faloon of Life Extension Foundation stated in a recent urgent message, echoing our own concerns: “The threat of a regulatory stranglehold over dietary supplements has intensified.”
We have at least three dangerous bills pending in the US Senate, any one of which could be a real disaster for Health Freedom.
S.3002 – the happily stalled McCain bill. We pushed back against this one so hard that even McCain withdrew his support from his own bill just one month and a day after introducing it! This took about 300,000 emails. However, the Senator from Arizona is still hovering around, trying to get parts of his “HARMonization” with Codex bill terms into the other pending bills.
S.510 – the fake “Food Safety” bill. The “natural products” industry shills and astroturf groups are now backing this disaster, after promises of a Manager’s Amendment to exempt DSHEA products. NOT GOOD ENOUGH. Over a million and a half emails continue to pour in, demanding real protection in these words:
“Rule of Interpretation – No provision of this act shall be deemed to apply (a) to any home, home-business, homestead, home or community gardens, small farm, organic or natural agricultural activity, (b) to any family farm or ranch, or (c) to any natural or organic food product, including dietary supplements regulated under the Dietary Supplement Health and Education Act of 1994.”

S.3217 – the Senate version of the financial institution “reform” law. California Rep Waxman included more power for the FTC to abuse in the bill that passed the house. Congress took away from FTC in the 80s its general rule making power, due to abuse. Now, in the “new” socialist DC environment, the agency is about to get the power it wants to force Dietary Supplement companies to meet drug-company substantiation standards that are totally inappropriate for food products and that could destroy small nutrient companies.

And the above does not include such extraordinary assaults on Health and Health Freedom as are embodied in the new nationalized illness payment system… but that’s going to get repealed sooner than its proponents can imagine! These other legislative assaults therefore demand our attention — we need millions of emails to the Senate to push back and stop them!
As all this is occurring, a Codex Alimentarius (the World Food Code) committee on nutritional labeling is meeting in Canada perhaps defining the fate of world food trade for decades to come. Breaking News! The Wall Street Reform and Consumer Protection Act of 2009 (H.R. 4173), just adopted by the House of Representatives (and sent to the Senate as S.3217) includes language giving more power to the Federal Trade Commission to make general rules for interstate commerce that could be used to restrict truthful information about dietary supplements, by requiring expensive, “drug company” level clinical trials before vitamin companies could make claims about their products. This “reform” could hand-over the natural products industry to Big Pharma, which, over the past few years, has bought up most of the larger vitamin companies. The new rules could become a “barrier against entry” driving many smaller companies out of business.
We address this issue in a new Action Item telling the Senate to provide protective language for natural products which do not need the same level of substantiation (called “significant scientific agreement”) that drugs should require for public safety. The existing commercial standard of “competent and reliable scientific evidence” allows natural product marketers to rely on published literature and small-scale clinical studies appropriate for food products. There is likely to be a GMO showdown at the Codex Committee on Nutrition and Foods for Special Dietary Needs.
The United States is vigorously pursuing its policy to prevent the labeling or identification of GMOs (or GMO-Free) anywhere in the world. That means that no one on this planet will be able to protect self or family from the dangers of GMO plants or animals. No one will ever be able to deterimine that the fact that they cannot have children is due to the GMO food they have been eating, unknowingly. Or their Cancer, or their Lupus, or the death of their babies. Without detailed traceability, Muslims, Hindus, Jews, Jains and others whose religion teaches that the must not eat certain foods will ever again be able to determine that they have avoided the foods that will make them religiously impure.
Organic will cease to have any meaning whatsoever and all food will be contamaintaed, given sufficient time.
This is what is at stake at the Codex committee meeting beginning this weekend. Codex is the battleground for the future of food — will the pro-GMO Globalist Agenda prevail, or will enough nations stand up for their traditional agriculture and customs and refuse to engage in a false
“consensus” that benefits only the Bigs — Big AgBiz, Big Pharma, Big Finance and Big Govt?
The United States FDA approves GMO foods and feeds without any safety testing of significance. Early on in the process of releasing GMOs, the company which owns the patented gene provides the FDA with whatever edited data it chooses to show that the organism is “safe”, no matter how weak, contrived or meaningless that data may be.
No further safety testing is carried out by the FDA, nor are further safety data reviewed, if they exist.
But, in the largest involuntary human experiment ever conducted, with zero informed consent possible, the world’s food, as it comes through the US food system, its seed system and its feed system, is contaminated with unlabeled, un-traceable GMOs. Any long term (or, for that matter, short term) effects will never be known because who is eating what GMO gene, promoter virus or bacterial marker sequence is totally unknowable. This is the effect of FDA refusing to require “truthful and not misleading” GMO labeling. In deed, the agency, in a true display of the arrogance of power, believes it has authority to censor even “GMO Free” labels!

Talking Points to Oppose S.510
1. The House passed the so-called, but mis-named, “Food Safety Modernization” bill, HR 4739, in July 2009, sending it to the Senate, where it is being considered as S.510. The Senate HELP committee “marked-up” the bill in November 2009 and the Manager’s Amendments were offered at the beginning of April 2010.
2. The Manager’s Amendments do not satisfy the Citizens Petition which demands:
“Rule of Interpretation – No provision of this act shall be deemed to apply (a) to any home, home-business, homestead, home or community gardens, small farm, organic or natural agricultural activity, (b) to any family farm or ranch, or (c) to any natural or organic food product, including dietary supplements regulated under the Dietary Supplement Health and Education Act of 1994.”
3. The bill as written threatens small farm, home, local and community food production with onerous rules that, while perhaps appropriate for industrialized food production, will create impossible “barriers against entry” that will rapidly destroy such local and natural production. No protective language is included in the Senate bill that satisfies these concerns.
As an example of the type of controls imposed, Section 106 provides in part for the regulations issued to be kept secret from the public, “In the interest of national security, the Secretary … may determine the time and manner in which the guidance documents issued under paragraph (1) are made public…”
4. The bill as written, in effect, incorporates the “HARMonization” provisions of the discredited “Dietary Supplement Safety Act” S.3002 and actually calls upon the FDA to recommend harmonization of American nutritional freedoms with Codex Alimentarius’ restrictions.
Section 404: “Nothing in this Act… shall be construed in a manner inconsistent with… any …treaty or international agreement to which the United States is a party.”
Section 306(c)(5): “Recommendations on whether and how to harmonize requirements under the Codex Alimentarius.”
5. Codex Alimentarius, a United Nations Commission administered and funded by the World Health Organization and Food and Agriculture Organization, promulgates increasingly industrialized food standards and guidelines. HARMonization of US food production with Codex standards and guidelines represents a serious degradation of US food standards. This bill mandates such HARMonization, to the detriment of US health and agriculture standards.
6. The vast majority of recent food safety scandals in the U.S. — E. coli on fresh spinach, melamine in dairy products, Salmonella in peanut butter — were all linked to industrial agribusiness practices. Large-scale operations clearly warrant more federal food safety oversight and strict enforcement action. What is NOT needed is a “one-size-fits-all” approach that poses unfair costs and onerous reporting on our safest farmers: local, family and organic farmers.
7. Registration fee ($500) regardless of farm size followed by blanket application of complicated monitoring and traceability standards and draconian fines for paperwork infractions ($500,000 or more for first time offense) will drive small farmers out of business.
8. FDA recall authority and fees represent a regressive tax on small farms and farmers which are unnecessary to prevent food contamination since virtually all food contamination outbreaks are the result of large-scale factory farming and/or massive food processing facilities.
9. Cost of Program: Section 401, $825,000,000 taxes in the first year.

The Natural Solutions Foundation has, as usual, led the health freedom community in sounding the warning about the fake food and supplement “safety” bills pending before the Senate of the United States. Our supporters have heeded that warning and delivered well over one million messages to Congress demanding NO fake safety bills and insisting that Congress provide protection for our supplements and natural remedies, not Codex HARMonization. But we are not finished, not by a long shot. Others believe that the current partial victory for our Push Back efforts is enough for us to stand down, focus on other things. They may be well intentioned but, as we said when Sen. John McCain’s S 3002, a veritable poison pill for supplements, was abandoned, we were pleased, but we, as the old saying goes, “were not home yet”. Well, once again, we are not home yet. S. 510 must be defeated if we are to protect clean food, fend off total industrialization of our food supply AND protect our supplements.
And Now, Here Are the Details
Well, the Senate has reacted to your PUSH BACK yet again, and yet again, has given us dangerous half-way measures at best. WE SAY THIS IS NOT GOOD ENOUGH!
Take the Action Item above; ask everyone you know to tell Congress: “NO! to the forced industrialization of our food supply!”
Back in 2007 when Sen Ted Kennedy gave Big Pharma his dying bequest… what it wanted most, more power — as Dr Ron Paul puts it, “to abuse” — we warned everyone that the FDA could not be trusted. That was when we had been told by various politicians – and even some misguided “health freedom groups” that it wasn’t “necessary” to have protective language added to the Kennedy “FDA Enabling Act” because, after all, they solemnly (and naively) assured us in DC, dietary supplements were not even mentioned in the bill. We said we didn’t trust FDA and that we wanted Dietary Supplements and Natural Remedies protected from enhanced FDA power. We persisted – YOU persisted – and we prevailed in the conference committee, with the help of hundreds of thousands of your emails, in keeping Section 1011, which exempted, and thus protected, dietary supplements, in the bill.
Nonetheless, within a year or so of that bill passing, FDA used its new Section 301(11)* power to ban interstate commerce in any food substance that had ever been studied for medical use in order to ban Pyridoxamine, a non-toxic form of vitamin B6. What gives the FDA the power to do this? Can you imagine why the Congress of the United States would believe it had Constitutional authority to deny food substances to any free people? Perhaps to perpetuate a Pharmopoly (pharmaceutical monopoly…)? Corruption and bribery, campaign funding and favors, perhaps? From the largest single lobbying force in the United States, perhaps? Conflict of interest, perhaps? Hmmmmm…
So in January of 2009, Pyridoxamine was banned. That’s right, banned. A natural, non patentable, safe and historically proven vitamin was banned to the American public. Despite its long history of safe use as a dietary supplement, it was not protected by section 1011 because, FDA says, no one “proved” it was grandfathered under DSHEA (the Dietary Supplement Health and Eduction Act of 1994)… and just because the substance was on the Old Ingredients List didn’t prove anything, blah, blah, blah… (Substances on the Old Ingredient list had always been considered grandfathered in under DSHEA, which holds that nutrients and supplements are to be treated as foods and, as such, cannot be limited or banned unless they are unsafe.)
The Other Shoe? Wait No Longer!
The FDA, which Dr. Rima refers to as the “Fraud and Death Administration, is about to drop the other shoe and ban more forms of B6. This time, the Phamopoly intent is blatant, since the “Citizens Petition” by the drug company involved actually states:
“Pharmaceutical companies developing new drugs must be protected from companies that may seek to market the ingredients in those drugs as dietary supplements. The marketing of such products has the potential to undermine the incentive for the development of new drugs because many people may choose to purchase the supplements rather than the drugs.”
Go back and read that quote again. The enormity of this is literally mind boggling! Instead of tossing this absurdity out, the FDA is, as always, playing the tune its Big Pharma masters demand.
So what does this have to do with the Fake Food Safety Bill, S.510?
Everything. You may recall that your million+ email PUSH BACK recently defeated Sen John McCain’s attempt to force Codex Alimentarius dietary supplement restrictions on us via his fake dietary supplement “safety” bill, S.3002. That bill died one month and one day after it was introduced… a real PUSH BACK record!
But, as we predicted and feared, attempts were made to include the worst parts of S.3002 in a revised effort to get S.510 passed. We saw that one coming, although, once again, others who should have known better, told us we were crazy. Once again, we asked you to message Congress through the Natural Solutions Foundation Action Item. Many hundreds of thousands of emails later, it appears that S.510 will be amended to “protect” DSHEA products. That sounds good ….
But That’s Not Enough.
Here’s what IS good enough: We want natural remedies and holistic techniques (like Holistic Ear Candling, for example) and all natural, local, community, family and farm food production protected too… better yet, DEFEAT S.510!
Please use this revised Action Item to make sure the Senate knows we are not happy… yet! If you have taken action on this issue, take it again since the Action Item has been revised to reflect the newest ploy on the part of the food destroyers. Please take it once for each member of your household and then pass it along to everyone you can reach with a simple note saying that this issue is of grave importance to you and you hope it will be to the person you are sending it to as well. Ask them to take action in the same way and then forward it to their circle of influence in the same way.
