We are facing oppressive and punitive government assaults and abuses of power in which safe and effective devices are seized, and their purveyors jailed, healing modalities and products are arbitrarily deemed “untested drugs and devices” when use for personal health strategies that do not pour profits into the pockets of the multinational drug and industrial food interests.
We are facing degraded food whose toxic and dangerous nature, both chemically and genetically, is kept hidden from us as an industrial secret so that we, as consumers,
cannot make health conscious choices about our food and that of our children.
We are facing a regulatory system so abusive that natural substances, although unpatentable, can be withdrawn from the market if a drug company expresses interest in
future exploitation of that nutrient as a possible drug.
We are encountering extra-legal and absurdly arbitrary and capricious re-definitions of nutrients as unlicensed, and therefore illegal, drugs if so much as a single scientific study has ever looked at the substance for any purpose or if no scientific study has ever looked at the substance for any purpose.
We are looking at the “HARMonization” of US regulatory standards and guidelines with international bodies in direct violation of US law and regulatory practice.
We are experiencing the selective enforcement of gag rules on truthful scientific speech to limit access to health benefits consumers might reasonably expect from natural substances and helpful devices.
The Natural Solutions Foundation knows that our time is short before we are facing the total criminalization and elimination of all meaningful autonomy over our own bodies and those of our children since the process of domination of our health choices by the State is accelerating rapidly. 2. Waxman’s Bill Threatens to Kill Dietary Supplements Through Hostile Regulation. Thousands Have eMailed Their Senators! We Need Millions!
The Wall Street Reform and Consumer Protection Act of 2009 (H.R. 4173), just adopted by the House of Representatives (and sent to the Senate as S.3217) includes language giving more power to the Federal Trade Commission to make general rules for interstate commerce that could be used to restrict truthful information about dietary supplements, by requiring expensive, “drug company” level clinical trials before vitamin companies could make claims about their products. This “reform” could hand-over the natural products industry to Big Pharma, which, over the past few years, has bought up most of the larger vitamin companies. The new rules could become a “barrier against entry” driving many smaller companies out of business.
We address this issue in an Action Item telling the Senate to provide protective language for natural products which do not need the same level of substantiation (called “significant scientific agreement”) that drugs should require for public safety. The existing commercial standard of “competent and reliable scientific evidence” allows natural product marketers to rely on published literature and small-scale clinical studies appropriate for food products. Congress is being asked to consider legislation to support our Health Freedom. BUT THAT’S NOT ENOUGH!
These bills include the recently introduced Free Speech about Science Act — H.R. 4913. This bill would ensure our basic Free Speech in health matters, end censorship and, according to observers, “enable the natural health products community to share peer-reviewed scientific findings about natural health products with the public…”
We have long urged support for Representative Ron Paul’s bills – HR 3394, the Freedom of Health Speech Act, and HR 3395, the Health Freedom Act. This new bill joins them to offer the possibility of a real turn-around in US law; finally supporting the intent of the Dietary Supplement Health and Education Act of 1994 (DSHEA) that we have broad freedom to use food for health and fully rejecting the FDA’s discredited public policy of “HARMonizing” especially with international restrictions on our rights.
At the urgings of a number of Health Freedom activists over the past months we’ve come to the conclusion that new laws are not enough to protect our fundamental rights. Only a Constitutional Amendment would fully enforce those rights. This idea has been around for a long time. Even Dr. Benjamin Rush, the leading American physician of his day, and a signer of the Declaration of Independence is reported to have supported a clause, which did not make it into the Constitution, to protect our access to health care and health information. Without such legal protection we’ve seen our health freedom eroded in the face of national illnesss care and international Codex food restrictions.
It’s time to correct that mistake. We therefore offer this first draft of the Freedom of Health Speech and Conscience Amendment. We invite your feedback and have created an online forum to discuss this issue. This language could be adopted by Congress as a statute, offered to the states by Congress to amend the Federal Constitution, or could be adopted by the state legislatures to protect the people of each state.

The Freedom of Health Speech and Conscience Amendment
Whereas “(t)he right of the people to be secure in their persons” including their health, are part of the rights reserved to the the people in the Constitution,
Whereas the Federal Courts have erected restrictions on the “standing to sue” in health cases and controversies, we urge the adoption of the following Health Freedom Amendment.
Each individual citizen of the United States shall have standing to sue in [federal/state] court to vindicate their health rights, including, protecting themselves and their minor children so that:
1. No individual (including a minor through his or her parents) may be denied, by any person or agency acting under color of law:
Access to any desired health care services, including those known as standard, conventional, alternative, advanced or complementary health care services, with fully informed consent;
Access to all health care information for which there is at least a scintilla of evidence;
Access to food, food components, contents or substances, including vitamins, minerals, amino acids, herbs, pro-biotics, pre-biotics, their precursors and metabolites; such components, content and/or substances may be offered with, or associated with, claims for their health benefits, without prior government approval and without limit as to mode of application.
2. No individual (including a minor through his or her parents) shall be exposed to genetically modified or degraded food without his or her consent. Such protection shall take the form of mandatory detailed labeling declaring significant alterations in the nature and composition of the food including, but not limited to, genetic modification of any sort, introduction of foreign DNA of any sort, irradiation in any amount, all pesticides, herbicides and fungicides and similar chemicals used at any stage in the production of such food.
3. No individual (including a minor through his or her parents) shall be subject to involuntary medication (including vaccination) or any other involuntary medical treatment. Any individual, if exposed to a public health hazard which poses a bona fide contagious public threat has the right to self-shield at home with appropriate material support to make such self-shielding effective. Such self-shielding shall be carried out for the minimum period of time necessary to control the public health hazard or contagion.
