The new CA law bars children from government and certain private schools unless they are vaccinated (after July, 2016). The legislature abolished the long-existing religious exemption for children.
.
However, the CA constitution says each child has a right to a “free” public education.
.
Various people are going to sue the state since Federal courts have long held that a state cannot condition the receipt of a public benefit (“free” public education) upon the surrender of a right (the right to Informed Consent) which has nothing to do with any now-abolished statutory religious exemption.
.
How will the state be required to accommodate the right of Informed Consent?
.
I don’t know… but I do know that unless you assert the right of Informed Consent, you will be deemed to have waived it. Since I am retired from the practice of law, I cannot give you any legal advice. I know what I would do if I were a CA parent…

You may want to send a certified letter to your school superintendent saying something like:

“I understand that the California Legislature and Gov. Jerry Brownshirt have abolished the statutory vaccination philosophical and religious exemptions for school children. The new law requires that children must be vaccinated to be allowed to attend school.
.
I am not seeking to assert a philosophical or religious exemption at this time, although I reserve that right, if the law changes.
.
I am now asserting my child’s international humanitarian right of Informed Consent. I do not give informed consent for my child to be vaccinated. Do not vaccinate my child. My child’s right to Informed Consent does not depend on any state legislature’s statutes.

How will the School District accommodate my assertion of right if my child is barred from the free public education to which each California child is entitled by the State Constitution?
.
Will you provide tutors for homeschooling my child? Will the district establish a separate but equal school for vaccine-free children? Who will be financially responsible if my child is injured by a vaccine?

You have a legal duty to accommodate my assertion of my child’s right to Informed Consent. I do not have a legal duty to surrender my child’s right to Informed Consent. The legal obligation is entirely upon the state and its agencies.

I call upon the district to immediately provide for lawful and equal access to public education for those of us who exercise our right to Informed Consent and choose not to vaccinate. If you condition my child’s right to a free public education on my surrendering my child’s right to Informed Consent, you are imposing an unconstitutional condition.

I would therefore hold you and the Board responsible in damages for violating my constitutional rights.

I expect an answer within ten days or I may initiate legal action without further notice to you.”

Remember, the US Govt hung a bunch of Nazi doctors at the end of WWII for violating the international humanitarian right of Informed Consent! The Federal courts are obligated to protect the right.

Maj. Gen. Bert Stubblebine (US Army, Ret.), the Foundation’s President, reminds us,

The AVD card, a laminated and signable plastic wallet card the size of a credit card or driver’s license definitively asserts your Informed Consent right to refuse any or all vaccinations.

Under the 2013 US Supreme Court ruling in Missouri vs McNeely, your right to Informed Consent is “waived” if that right is not definitively asserted. A “waived” right is no longer active and is considered to be nullified/cancelled/surrendered. When the right is asserted, however, is in preserved and violation of it becomes assault, battery, malpractice and may constitute a Crime Against Humanity by forcing medical treatment on an unwilling victim.

The AVD is consistent with the well-established principle of Advance Health Directives in the Common Law countries like the US where “Living Wills” or other written directives to health care personnel define advance medical choices.

In the US, for example, a document on your person asserting your vaccine refusal protects that medical choice under the law

Natural Solutions Foundation’s Advance Vaccine Directive, like any other Advance Health Directive (e.g., “Do Not Resuscitate” or “DO Resuscitate”, etc.) or any other Advance Health Notification (e.g., “I am allergic to penicillin” or “I am a diabetic and require insulin”, etc.) informs health care providers of your Right to Informed Consent, even in situations where you cannot speak for yourself.

According to Rima Laibow, MD, Medical Director of the Foundation, “It is standard practice for ER intake to review the patient’s personal effects to determine if there is an Advance Medical Directive or Medical Warning bracelet/necklace/card or similar present and follow that directive.”

Counsel for the Foundation, Ralph Fucetola JD writes, “After careful research we have created a wallet size card which is a legal document asserting, as required under Missouri v McNeely, that by signing and dating the AVD card, the person is issuing an Advance Vaccine Directive and asserting their Right of Informed Consent to refuse all vaccines. This is a legally binding declaration and, we believe, protective no matter what the status of local or even Federal law since the right to Informed Consent is fully protected under International Treaty Law which supersedes local, regional or national civil or martial law.”

Counsel Fucetola cited the Nuremberg Code which requires Informed Consent for any medical experimentation or treatment without “…the intervention of any element of force, fraud, deceit, duress, over-reaching, or other ulterior form of constraint or coercion…” and the US Supreme Court’s 2013 holding in McNeely, noting that even a “…diminished expectation of privacy does not diminish the… privacy interest in preventing a government agent from piercing the… skin. … [T]his Court has never retreated from its recognition that any compelled intrusion into the human body implicates significant, constitutionally protected privacy interests…” [Emphasis added.]

Of course, these good doctors were using natural, non-toxic means to cure, yes, CURE, autism, cancer and other degenerative diseases of immune distortion and failure. That’s the link..
Two of the most recent, and unexpected, deaths, autism doctor Jeff Bradstreet and cancer doctor, Nick Gonzalez, appear to point to the fact that both of them were looking at, and using, supplementation with a naturally produced immune factor.

So the masters of death and their government minions didn’t stop when the SV40 cancer-causing virus was removed from the polio vaccine (after knowingly infecting 98,000,000 Americans). They appear to have gone on to lace our vaccines with a substance with almost endless immune suppressant capacity so that they could the sell us drugs and chemotherapy agents when our immune systems failed us.

The (G)OP-controlled House, with support of all but the handful of freedom stalwarts, just adopted HR-6 [the “21st Century (sic) Cures Act”] with billion$ in goodies for Big Pharma. The bill was introduced in mid-May; out of committee on July 7th; adopted on July 10th*… barely a word of debate… congressional gridlock, not!

There is always bipartisan cooperation whenever our Liberty is to be attacked.

The bill specifically abrogates our fundamental human right of Informed Consent by telling Big Pharma it no longer needs the Informed Consent of the of the subjects of human drug experiments if there is “minimal risk” — and you know who gets to decide that! The Informed Consent right does not depend on someone else’s determination of the risk! Informed Consent says, in essence, each free, adult person has the sole right to determine what medical risks, if any, the person is going to take.

After being adopted by the House of Representatives on July 10th HR-6 was rushed to the US Senate on July 13th and sent to a committee for fast-track action. That was when your Push Back got noticed. We’ve been in close communications with several pro-liberty groups, such as Ron Paul’s Campaign for Liberty, and with the offices of Senators Lee and Paul. The last communication from Sen. Lee’s office was helpful, and we’ve been told to keep up the pressure!

From what I’ve heard from the Senate HELP committee, the committee intends to start from scratch with their own version of a health care bill and doesn’t intend to bring 21st Cures to a vote—at least at the present.
