Vaccine Pushers Push Back Against Conscientious Objectors

These past several years, across the so- called Civilized World, from California to Italy; from France to Australia, alleged democracies are adopting draconian laws to force parents to vaccinate their children against their wishes and beliefs.

Initially, decades ago, laws were adopted requiring a limited number of childhood vaccines as part of public school attendance. All these laws allowed doctors’ medical excuses for individuals who were, in the words of the US Supreme Court, “not fit subjects for vaccination…” (Jacobson v Massachusetts, 1905). Nearly all allowed religious and or other conscientious exemptions.

In the middle of the 20th Century the international law of Informed Consent, developed in response to horrendous violations of the dignity of the person during World War II.
.

“The voluntary consent of the human subject is absolutely essential. This means that the person involved should have legal capacity to give consent; should be so situated as to be able to exercise free power of choice, without the intervention of any element of force, fraud, deceit, duress, over-reaching, or other ulterior form of constraint or coercion; and should have sufficient knowledge and comprehension of the elements of the subject matter involved, as to enable him to make an understanding and enlightened decision.” (the Nuremburg Code)

The roots go back much further, to case law holding that a physician who engages in a medical intervention without the Informed Consent of the person commits an assault and battery (Schloendorff v. Society of New York Hosp, 1914).

As recently as 2013 the US Supreme Court (Missouri v McNeely) reiterated its understanding of the law:  even a
.

“…diminished expectation of privacy does not diminish the… privacy interest in preventing a government agent from piercing the… skin. And though a blood test conducted in a medical setting by trained personnel is less intrusive than other bodily invasions, this Court has never retreated from its recognition that any compelled intrusion into the human body implicates significant, constitutionally protected privacy interests…”

For reasons about which we could speculate our elected representatives have forgotten these salutory limits on their authority.

It started in California where a measles outbreak triggered among the vaccinated became the excuse for a new law, SB277, which conditioned attendance at school upon receiving dozens of vaccines, with no religious or philosophical excuse allowed. Gov. Jerry Brownshirt signed the bill although the California Constitution guaranteed a “free public education” to each child. Apparently lawyer Brownshirt had never heard about “unconstitutional conditions” — making someone surrender one right to gain another.

And the ball began to roll. Australia adopted a law conditioning child financial benefits on vaccination, with only medical excuses allowed. For many families the choice became having food on the table or vaccine-free children. This law was adopted despite clear constitutional language protecting the universal right to Informed Consent.

More recently both Italy and France have seen forced vaccine laws, met in Italy with mass demonstrations against the new requirements.

So now the vaccine enforces have raised the ante again. The Australian Government just introduced a law, with the full support of the “Opposition,” making it “child abuse” to refuse to subject your child to what courts around the world have called “unvoidably unsafe” vaccines. Doctors in Australia who are issuing medial exemptions are having their licenses suspended.

Late last year the US Congress adopted the “21st Century Cures (sic) Act” which, among other impositions, unlawfully exempts drug companies from obtaining written Informed Consent in certain circumstances.

Around the world it goes. The power of the vaccine pushers appears to be acendant, but, in reality, what is happening is that the opposition to forced vaccination is growing so rapidly that the Government-Pharmaceutical Complex is forced to move to ever more draconian measures to enforce the vaccinate-at-any-cost policy.
.
As the science becomes ever more clear, that vaccine-free children are significantly healthier than vaccinated children, the profit-driven urgency of the vaccine pushers becomes ever more desparate. That is why the recent call for a Five Year Childhood Vaccine Moratorium has been met with such feined horror, with nations like China (the world’s #1 vax toxin producer) cheering on Australia’s recent decsions to ban vaccine freedom campaigners from traveling to Australia, as threats to “public order.”

Kent Heckenlively, JD, a California attorney at law and father of a vaccine injured child, Rima E. Laibow, MD, Medical Director of the Natural Solutions Foundation, and Ralph Fucetola, JD, President of the Institute for Health Research, and a Trustee of Natural Solutions Foundation, announced the filing of a formal Administrative Procedures Act (APA) Petition to the Food and Drug Administration (FDA) and Centers for Disease Control (CDC) at Regulations.gov, on July 27, 2017,  filing receipt 1k1-8xr6-qzjy, Docket No.  FDA-2017-P-4500.

Counsel Heckenlively remarked, “This formal filing today at Regulations.gov joins the WhiteHouse.gov petition I filed earlier this month. We are establishing our legal standing to call for the Five Year Childhood Vaccination Moratorium. The FAQs page for the twin petitions is http://tinyurl.com/vaccinemoratorium. Both petitions demand the same remedy: a Five Year Childhood Vaccine Moratorium.”

Institute for Health Research President, Ralph Fucetola JD, with 35 years legal experience in regulatory law, explained the reasons for the filing:

“Under the APA formal Citizens Petitions to government agencies have legal standing to begin the process of adopting regulatory changes, either through the agency directly or by White House Executive Order. Many people are unaware that most Federal rule making starts with a Citizens Petition. The two petitions submitted by Counsel Heckenlively together deliver an important message to the Federal Government regarding uninsurable vaccines that have been determined by courts to be ‘unavoidably unsafe’. We demand a moratorium on childhood vaccines until and unless they are proven safe and effective, as required by law.”

The third signatory on the APA Petition, Dr. Rima Laibow, further commented:

“Childhood vaccines have never been proven safe and effective. Rather, they have been shown to be unavoidably unsafe, with the ever-increasing list of recommended and mandated vaccines leading to ever higher levels of chronic illness especially among vulnerable populations such as children. It is an unconscionable violation of medical ethics and the right to informed consent for physicians to push highly profitable multiple vaccinations on children that will probably cause harm to those children. We must have a moratorium on childhood vaccines to save the children.”

Should the Federal Government fail to act to protect the health of vulnerable children, the filing of the petitions gives rise to formal standing to sue for the agencies’ failure to assure, as required by law, that new vaccines are safer that older vaccines, and that all vaccines be safe and effective.

Your Pediatrician Cannot Abandon Your Vax-Free Child!

I have a friend with two young children who does not want them vaccinated. Today she went to their pediatrician armed with our Advance Vaccine Directive card and did the following:
.
She had a copy of the front and back of each girl’s card which she signed.
.
She asked the doctor to sign it and enter it into the permanent medical record of the child.
.
The nurse receiving the request “lost it” and began to become belligerent, saying that the children could no longer be seen in that practice if they were not vaccinated.
.
My friend called me and, as it happened, called Counsel Ralph too because we were together at the time.
.
Counsel Ralph told her to tell the staff that they were abandoning the patients simply because they were asserting their nationally and internationally protected legal right of Informed Consent and that this was a violation of the law.
.
Another nurse showed up and escorted my friend into a side room lest the other mothers in the waiting room hear the conversation.
.
She agreed that the mom could assert the right of Informed Consent for the children with these cards and that the practice could not abandon the children.  The copy of the Advance Vaccine Directive card for each child was put into each child’s medical records, although the doctor refused to sign it.
.
In popped the Doctor who angrily demanded to know what the problem was.
.
The nurse shooed him out after calming him down.

Note from Dr. Rima: more than half of the income of the average pediatrician comes from vaccinations.

I am reminded of the angry patron who calls over a waiter and says, “Waiter! There is a fly in my soup!” “SHHHHH!!!” says the waiter. “Please lower your voice, Sir, or everyone else will be wanting one, too!”

Oh, dear! What if all the other moms realized they did not have to vaccinate their kids, either!
.
Nurse tells mom in side room that she is quite right and that she will find her a pediatrician who will accept mom not vaccinating her kids. The child’ medical records, including the AVD Card, will be transferred to the new physician.
.
Mother leaves and within 20 minutes the nurse calls mom and says that there is a doctor in mom’s town who will accept unvaccinated kids and who is considerably closer than the doctor mom was seeing for her kids.
.
Mom writes email to doctor when she gets home notifying his office of the events listed above.
.
Doctors are sometimes paid hefty bonuses for vaccinating kids. That is a kickback although it may be craftily worded to avoid that legal irregularity.
.
Here is what Dr. Sears has to say about the practice:
.
“… I recently talked with two physicians in different states that told me the HMO plans that they contract with do chart reviews and patient surveys at the end of each year. If their office scores high enough on these reviews, the HMO plan gives them a several thousand dollar bonus. This bonus varies depending on the number of patients the doctor sees. One of the requirements for a patient’s chart to pass the test is that they are fully vaccinated.”

He goes on to point out that “The American Academy of Pediatrics Committee on Bioethics makes it very clear that the official AAP policy is that doctors NOT kick patients out of their office over this issue. But when money talks, some people don’t listen.”
.
He does not mention that the American Academy of Pediatrics could not be more hard core pro-vaccine – any vaccine, every vaccine – than they are.
.
Yet approved behavior or not, pediatricians do “fire” young patients when their parents do not want them poisoned with ineffective and dangerous injections of pus and toxic materials.
