In all of my days in Military Intelligence, the new Health Emergency is perhaps the most ominous domestic event I have ever encountered.
In the struggle to save Health and Freedom we are out of time.
We either take this hill, or we die on it.
Germany declared war on the German People during the Nazi regime and, as you know if you have read Dr. Rima’s hugely important and informative”The Killing Camps of Codex”:

Russia declared war on the Russian people under Stalin who killed at least 30 million (!) Russians in his mad tyranny, perverting medicine and especially psychiatry in the process.
Has the United States declared war on the American people today? Is that declaration part of the WHO’s war against the population of the earth? Sadly, tragically, it would appear so.
In the Intelligence world, the task is to take seemingly disconnected pieces of information and find the pattern that binds them together into a cohesive whole. After that, you evaluate the forward progression of events and work to either support those that you want to see happen or forestall those that you do not.
The President’s declaration of a National Emergency provides authority to an appointee, HHS Secretary Kathleen Sebelius, to literally throw out of the nearest window ALL of the protective rights of a patient who is caught up in the health care system, whether or not they actually have the trivial disease called “Swine Flu”. Anyone, in fact, can be sucked into this system. None of this makes any sense UNLESS the intention is to replicate Hitler’s actions in Germany which used the all too willing medical system as a means to eliminate individuals, segments of the population and anyone who dared to speak out (or whisper) against the regime.
Again, this incredible expansion of power given to HHS strips every American of any rights or recourse.

I am a Health Care Worker. My New York State Medical License Number is 111813. I will not be part of a system that harms and incarcerates people. I will not be part of a system which uses drugs to subdue and kill dissidents and socially inconvenient people, also known as “useless eaters”.
If you are a Health Care Worker reading this, neither will you. If you are not a Health Care Worker and you are reading this, you know Health Care Workers, students, administrators, Janitors, Cooks, Clerks, etc., etc., who won’t either. So you’ll need to get them this information as quickly and effectively as you can. Ask them to take the Health Care Worker’s Oath and pass it along to their colleagues. After all, when we said “NO!” to the Swine Flu vaccines, look what we accomplished.
It’s time to act again. And, of course, it’s time for every Health Care Worker to send the letter demanding redress to President Obama by having him rescind the Declaration of Health Emergency, just as NY State rescinded its Health Care Worker vaccination mandate last week.
I urge all conscientious health care workers to join me in taking an oath never to violate basic medical ethics, to Do No Harm, and to obey the principals of the Nuremberg Code and the Declaration of Helsinki: we will not be “good Germans” in the planned medical fascism.

Just a few days ago we told you that we had won a decisive victory in the Pandemic Wars when HHS Secretary Sebelius called off the Pandemic. And, indeed we had won that victory. At the time, I told you that the other side would be back, and that is exactly what has happened. But we ARE ready for them.
The day before, DHS Secretary Napolitano opined that there would not be any economic impact to the Swine Flu because, in essence, there was no Pandemic. Two days later, New York State, bowing to public pressure – ours! – rescinded the dreadful mandate that had been placed upon health care workers for not just the Swine Flu vaccine, but all, that’s right, ALL vaccines recommended by the CDC’s bought-and-paid for Advisory Committee on Immunization Practices.
But how will the depopulation happen if there are no Swine Flu vaccinations? How will the profits for secondary disease roll in if there are no Swine Flu vaccinations? How will the political “readjustment” take place if there are no Swine Flu vaccinations?
These are serious problems for the controllers. So last Friday evening, on October 23, 2008, flying in the face of logic, shame, sense and science, President Obama, who remains unvaccinated, as do the First Daughters, declared an absurd, but very dangerous “National Health Emergency”.
It will, apparently happen through the cooption and involvement of the health care system which is already controlled by Big Pharma. Fascism is the merger of the corporation and the state. This emerging fascism is nothing short of breathtaking: Big Pharma and its Global State, or is it the Global State and its handmaiden Big Pharma? They are not separable any longer. But what is clear is that the use of their corporate structures will be needed to create the next step in the destruction of your way of life and mine – and perhaps your life and mine, as well.

A Petition to the President of the United States
Dear President Obama,
I am writing to you in order to exercise my rights under the First Amendment Constitution of These United States for the redress of grievances. Your Declaration of Health Emergency on October 23, 2009 gives appointed officials illegal, and unconstitutional powers which threaten my life, liberty and well-being in a clear and present way. This Petition urges you to remove this threat from me and my fellow Americans immediately since the only possible outcome of the unnecessary Declaration is to use the medical system to abridge my Constitutionally protected liberties. I am writing to you at the suggestion of the Natural Solutions Foundation, a preeminent Health Freedom organization.
Other decision makers are receiving copies of this Petition. They include Secretaries Sebelius, Napolitano, the Governor of my State, my State Legislators and my Federal Legislators.
Many Americans strongly challenge and oppose your declaration of a “Swine Flu National Health Emergency” in the absence of science or clinical reality. Political issues and a desire to curtail all Constitutional rights appear to be driving this unwarranted and excessive exuberance to push for dangerous and untested vaccines, with this Declaration that provides for internment and forced treatment. I fear that the same kind of “eugenicide” now being practiced as cost containment-mediated death strategies in the UK will be used to reduce the costly population of such medical gulags. Given the co-option of medical systems in recent genocides, this is not an unlikely outcome to this policy. As a Constitutional scholar and student of history, you should be well aware of this.
I urge you, Sir, to reverse your policy and your position as Secretaries Napolitano and Sebelius have already done both in statements and before Congress concerning any “Health Emergency”. They agree. There is none. The danger here is from the unwarranted powers assumed by the Executive under the guise of an “emergency.” History suggests to us dangerous precedents. We cite, as just a few examples, the “false flag” Reichstag fire; the faked Gulf of Tonkin attack and the non-existent Weapons of Mass Destruction in Iraq.
As an American, I value the Constitutional rights that you are sworn to protect and which you, as a Constitutional scholar, well understand. I am stunned and dismayed by your pronouncement of a National Health Emergency on October 23, 2009, regarding the 2009-H1N1-A “Swine Flu”, given the following facts:
– According to Health and Human Services Secretary Sebelius’ announcement on October 21, 2009, and her Congressional testimony the following day, the incidence of H1N1 Swine Flu will peak in the next week
– 40% of the population has already been infected
– The arrival of the $6.4 Billion dollars’ worth of vaccine, including $485 million dollars of unapproved, injectable squalene designed to serve as an external adjuvant, will come “too late” to provide any protection against the Swine Flu.
– More than $485 million dollars of a dangerous, untested and unapproved adjuvant, squalene, has been purchased for injection well in advance of the first appearance of the supposedly novel Swine Flu in April
– Neither squalene itself nor its proprietary versions are approved for injection into humans
– Good Manufacturing Practices make it impossible to admix squalene at the 90,000 innoculation sites now being set up around the country. The extreme danger such a variation from proper medical manufacturing practice standards should be obvious.
-Squalene, at the high doses found in both the Novartis and GSK approved vaccines, and in the admixture program announced on the FDA’s website, causes, in the presence of glycoproteins, an irreversible infertility because of immune system stimulation. The human body is rich in glycoproteins, including hormones necessary for fertility.
-Incarceration at sites remote from hospitals, administered through medical systems, which your declaration allows, is a position very far down the slope of medical systems being co-opted into participation with extermination programs which we have seen all too recently. The Nuremberg Code [ http://www.hhs.gov/ohrp/references/nurcode.htm ] does not have an exemption for “declarations of national emergency.”
-No redress, appeal or other Habeas Corpus remedies are provided for under the powers available to the Secretary in your Declaration making these powers unconstitutional.
The facts, reported by your Secretary in a Press Conference on September 20 and again before Congress on September 21, 2009 make it very clear that the alleged intense danger cited of a “Swine Flu” outbreak prior to her announcement and testimony is no longer a reality, making your Declaration unnecessary.
If your Declaration was intended to legalize the bizarely dangerous admixing of adjuvant and vaccine outside of pharmaceutical or medical facilities, you must take full responsibility for the resulting harm. Not even, however, in a declared emergency can any national authority allow the violation of basic medical standards nor their distortion into the administrative and action arms of incarceration and extermination policies.
I petition you as Chief Executive to abide by the restraints and protections afforded me by the Constitution of These United States, the legislative and regulatory protections afforded me in consequence of the Constitution and, indeed, the basic standards of civilized behavior with regard to medical treatment, In short, I appeal to you to stop this madness now! Your Declaration will only precipitate public panic over what has proven to be a relatively mild flu.
Further, the number of flu cases cited by the CDC, as with those cited by the World Health Organization, are based in speculation, not science. The WHO and CDC asked countries, states and counties to cease counting cases of “Swine Flu” several months ago since laboratory confirmation was inaccurate at least 90% of the time, making any morbidity and mortality numbers meaningless.
A recent study, conducted over the past 3 months by CBS found that Swine Flu “cases” were inaccurately diagnosed between 83 and 97% of the time (average inaccuracy rate: 90%) which is consistent with the FDA’s and CDC’s announcements in the past several months that accurate diagnosis was not possible 90% of the time, making the effort to achieve such diagnosis meaningless and futile.
In the complete absence of any accurate morbidity and mortality data, and in the presence of a stated peak of this coming week, followed by the logically necessary decline in even estimated cases, there is not now, nor has there ever been, a health emergency that would give you the authority to make the Declaration you have made.
What there has been, Mr. President, is a shamefully deceptive marketing campaign to defraud the American people and those around the world who look to our good science (here absent), our good public policy (here absent as well) and our good sense (nowhere currently in evidence concerning this “pandemic”).
Instead, 5 vaccines which are dangerous and totally untested have been approved in the total absence of any information on their specific safety profiles while we know that their principle components are dangerous in themselves. Two of these vaccines are, in contradiction to the testimony of Secretary Sebelius on September 15, 2009, adjuvanted with highly toxic substances.
Medimmune’s Live Attenuated Influenza Virus nasal mist vaccines are associated with profoundly unacceptable adverse events including meningitis, Guillan-Barre Syndrom, sudden death and a host of other documented dangers including a documented overall three fold increase in hospitalizations for all causes in children who recieve them.
Secretatry Sebelius stated in her testimony before Congress on September 15, 2009 that these four approved vaccines are not adjuvanted (extended with the use of immune system irritants). In fact, the other three vaccines approved at that time, all without any testing, contained aluminum (a potent neurotoxin adjuvant) and, in the case of the Novartis vaccine, according to Novartis itself, MF59, its propriatary squalene adjuvant. However, your Department of Health and Human Services did not know, when we discussed this with the Secretary’s office, what MF59 contains and told us to check that with Novartis. We did. They pointed us to a web page that said the “oil in water” adjuvant was “proprietary” — so the government doesn’t even know what is in the vaccine it approved!
According to our information, Mr. President, another vaccine has been added to the roster of “Swine Flu” vaccines for this non-event of a “Public Health Emergency”: GSK’s oil and water and aluminum adjuvanted vaccine. This was the fifth vaccine which your government purchased, but could not approve because, as Secretary Sebelius testified, “our scientists don’t want us to go down that road…” If your Declaration was intended to legalize the use of this dangerous, unapprovable drug, you must accept full responsibility for the harm it will cause.
Whether injected either through on-site admixture or in-vial contents, squalene is the undisputed source of profound disability and, in a high percentage of cases, death from the pervasive and irreversible auto-immuner disorder it precipitates.
“Breaking tolerance”, or stimulating the immune system to attack its own body – eventually in every tissue, is, in fact, what injected squalene is used for in the laboratory, where it is known as “Freund’s Complete Adjuvant” after its discoverer, Dr. Jules Freund. The disorders it causes in experimental animals are so profound and debilitating that there is considerable debate in the scientific community over whether it can ever be used ethicially within the boundaries of humane animal experimentation. In humans, these disorders are known collectively as “Gulf War Syndrome” which felled and eventually killed more than 25% of the healthy young service men and women into whom it was experimentally injected – and still is being used. The doses of squalene being used in the Swine Flu vaccines and admixtures are one million times stronger, in line with the 1998 patents which show that such doses will create sterility in those who receive them.
Mr. President, this means that an entire generation of children and fertile adults (the pregnant women in the high risk group of first vaccine recipients) will be rendered sterile. This constitutes willful negligence on the part of the US Government, its agents and all manufacturers.
No wonder vaccine makers and the US Government are eager to see these vaccines administered quickly, before any formal safety testing has been done.
There is more grievance that I urge you to redress, Mr. President: all multiple dose vials contain one of the most potent neurotoxins known to man: mercury in the form of Eli Lilly’s creation, Thimerisol. This product was grandfathered in on the Generally Regarded As Safe (“GRAS”) list after one of the most shameful travesties of scientific investigation ever perpetrated this side of the Nazi concentration camps: 22 patients in coma from meningitis were injected with thimerisol, which is 49.6% pure mercury by weight. All of the patients died.
Lilly reported out to the newly formed FDA that Thimerisol did not harm the patients because “they would have died from other causes anyway”. The Agency accepted this obvious assault on logic, truth and decency and we have been facing the tragic results of neurological poisonings in our children’s – and our – syringes since the early 1930’s.
Mr. President, you are a father. The precious daughters whom you cherish could be destroyed by these vaccines, yet there is no danger to them from the Declared Public Health Emergency.
You clearly see that because you have not chosen to submit their young bodies to these vaccines despite the fact that the CDC and FDA have declared them to be in the highest risk group for Swine Flu: healthy children.
We therefore petition you to issue another Declaration to make it clear that no person shall be mandated to receive any of these vaccines under any conditions and to rescind your current Declaration so that the medical system is not used to create gulags.
You have full control of the issue now, by your Declaration, and must therefore accept full responsibility: will you force Americans to receive these drugs and accept medical internment without Constitutional or scientific justification or will you affirm our right to free choice in these matters and rescind your dangerous and unnecessary Declaration?
The other highest risk groups, pregnant women and people with chronic diseases, are at highest risk for damage, often irreversible, from these vaccines. This irreversible damage includes death all too often, as the emerging data in Sweden, Hungary and other countries using GSK’s squalene adjuvanted H1N1 vaccine are demonstrating right now, following early vaccinations in those countries.
There are other dangers, Mr. President, in vaccinating against a non-existant threat. Under the best of circumstances, using the most favorable of assumptions, the FDA estimates that at least, at LEAST, Mr. President, 30,000 people will die from the vaccines and at least 100,000 will suffer serious adverse events. That is not an inconsequential estimate, Sir.
In fact, there is not one whit of scientific evidence to demonstrate that the desired antibody titer of 40:1 has any protective value against the Swine Flu, or that any other flu vaccine has any protective value against any flu and, for that matter, the necessary (and widely assumed to be present) double-blind, placebo controlled studies, or the long term follow up studies demonstrating long term safety are absent, as well.
Moreover, there is grave danger to the future of your Country and mine, Mr. President, because of the use of the AS02,3,4 and MF59 adjuvants at all and especially in the doses in which they are being injected into our youngest, fertile and most vulnerable population. I am gravely concerned that the WHO, which required that the oil and water adjuvants be put into the vaccines which have been produced in the absence of either safety or sense, and at doses 1,000,000 times that present in the dangerous experimental Vaccine A will, in the presence of both naturally occurring and introduced glygoproteins (richly present in the human body), produce an immune-mediated, irreversible sterility. And I am concerned that the US will help them in this long-sought, but genocidal destruction of global fertility. Surely you know that the education of females, in every culture, is the surest way to a substantial reduction in birth rate while the quality of life of the community these women live in rises dramatically along every parameter. If your concern is for well-being on either a local or a global basis, why is the global education of girls and women not your priority?
Given that the WHO has been working vigorously on infertility vaccines through its special commissions since 1974, and has deployed them against third world populations in every part of the world, and given that two patents filed in 1998 make such permanant and irreversible sterility an irreversible consequence of these adjuvanted injections, I have grave concerns for the continued ability of the US population to reproduce. Given also that the Workd Health Organization has stated that massive population reduction, which is in line with the stated goals of US Foreign Policy for global population reduction, the use of these dangerous vaccines on pregnant women and children FIRST is of overwhelming concern to me and must be to you as well, Mr. President.
The Department of Health and Human Services Secretary, Janet Napolitano, stated on October 23, 2009 that there would be no economic consequences to the Swine Flu in the US. On October 22, 2009, the Governor of New York State recinded the mandatory vaccine health care worker mandate placed upon those workers on 2 months earlier citing “vaccine shortages”.
The only economic impacts which will result from this Swine Flu non-pandemic are the waste of $6.4 billion dollars in a severely damaged economy and the loss of the inestimable income to the illness care industry which the chronic, degenerative and disabling diseases caused by these vaccines would generate.
Your daughters are unvaccinated, Sir, as are you. Surely if there were a health emergency, you and your family would be treated with a meaningful preventive strategy which differed in no way from that offered to other Americans and might, indeed, exceed that available to others. I believe that your lack of vaccination is, in fact, a superior health care strategy reserved for the powerful.
In Germany, politicians like you have exempted themeselves and members of the military from adjuvanted vaccines decreeing, at the same time, that the rest of the German population is to receive vaccines with adjuvants.
Are we secretly playing that game, Mr. President, with the lives and the health of every American, or is the game plan that the powerful and their children, including your own, will abstain from the dangerous “treatment” forced upon the rest of us?
The irrational haste with which innoculation of unsafe, untested, unnecessary and uninsurable Swine Flu vaccines has moved forward seems to me to correspond with the veil of immunity which manufacturers, the Federal Government and their agents which prevents any tort or other liability for dangerous, or even deadly, vaccines unless those companies, agencies and person act with willful negligence. Once the safety testing has been carried out, and the dangers of the vaccines have been abundantly document, their use would likely constitute “willful negligence”, leaving all involved organisms, both corporate, private and government, liable to enormous damages from the grieving and ill patients and parents who were damaged by this vaccination program.
There is no Health Emergency to derclare, nor has there ever been. To make it even slightly plausible to declare a Level 6 pandemic on June 11, the World Health Organization had to eliminate the concepts of a novel agent causing widespread serious disease and death from the definition of “Pandemic”.
This “Pandemic” is a non-threat. The vaccines, and the distortions involved in manipulating the people of the United States and, through its leadership, the rest of the world, are the real dangers and they are considerable.
I have signed this letter, Mr. President, in order to petition for a redress of the grievences which you are overseeing and which you have perpetrated through your Declaration of Health Emergency on October 23, 2009. I urge you in the strongest terms to abandon a strategy based on failed science and dangerous consequences of unprecedented proportion.
My future, America’s future and the future of freedom depend on it.
You have chosen to transform a non-pandemic which was, by your own Secretary’s testimony, peaking next week, into a nation emergency. You must therefore now show us that you will treat this process with the transparancy you have repeatedly promised the American people and the world.
Will you tell us that we need to sacrifice more of our freedom for some alleged pandemic security, or will you now publicly affirm that none of the vaccines covered by the Declaration shall be forced upon any person, by mandate, or by threat to withhold public benefits, jobs and schooling? Will you incarcerate us in medical gulags or will you allow us to move freely without the fear of medical concentration camps, detention centers and eugenicide?
The entire nation, and because of the position of leadership which the US has earned in the past, the entire world, awaits your answers will hold you accountable.
Is your legacy to be our illness, sterility and death through dangerous drugs which have no medical reason for their use?
I petition you for, and expect, your unequivocal response in restoring freedom and restoring sanity to the man-made debacle confronting us. Announce that no American will be forced to receive any alleged pandemic treatment or alleged preventative measures. Rescind your Declaration of Health Emergency and officially end the Swine Flu Pandemic.

In a stunning initial step toward victory in the battle to make our own health care decisions, citizen push back pushed back really hard. The Public Employees Federation, New York State United Teachers and an attorney representing 4 Albany, NY nurses challenged the NY State order mandating vaccination with all ACIP recommended vaccinations, including seasonal and Swine (H1N1) vaccines for nurses, doctors, aides and non-medical staff members who might be in a patient’s room. For now, the vaccinations will remain voluntary.
Natural Solutions Foundation’s ‘Stop the Shot’ litigation also deals with the rights of NY State Health Care Workers, in addition to challenging the legality of the vaccines themselves. The litigation has been filed in the District of Columbia Federal District Court in order to create a stay which has national impact. Additional states, such as Pennsylvania and California, have promulgated mandates similar to those in New York.
The Natural Solutions Foundation’s Trustee and lead Counsel, Ralph Fucetola, JD, has been asked to provide an Amicus Curiae [“Friend of the Court” brief – REL] in this case because of our extensive research and involvement with the issues in this case and we are, of course, proud to do so.
Distressingly, ACIP has been discounting or eliminating exemption categories in its recommendations for vaccinations which means that such exemptions, although allowed under the laws of all states for medical reasons and 48 states for other reasons, are increasingly not permitted for ordinary vaccinations and are disallowed for pandemic vaccinations. This is not acceptable to people who believe that, as free men and women, they have the right to make their own decisions about what goes into their bodies.

The underlying Complaint alleges that the government failed to follow its own rules and applicable legislation in rushing the vaccine approvals in the absence of any of the requisite minimum scientifically sound and appropriate testing for both safety and effectiveness as required by law since 1964.
The new Motion asks the Court to act immediately to stop the swine flu shots.
The government, which owns all the approved vaccines, has begun delivery this week of what they describe as the novel “Swine Flu” 2009-H1N1-A live virus nasal mist vaccine to 90,000 government-approved locations nationwide. Before the Court will have time to act, hundreds of thousands, if not millions, of Americans will take the nasal mist vaccine and, according to the nongovernmental physicians and scientists who oppose these vaccines, will become infectious, possibly triggering the pandemic the government has been predicting. The company which makes this mist vaccine states on their web site that their vaccine causes a “mild” case of the flu alleged to provide immunity to the admittedly mild “swine flu” which has so far failed to become pandemic.
Frankly. we do not know if we will be in time to prevent the pandemic.
The case of Null, Laibow et al. v FDA et al. challenges the legality of the September 15th, 2009 licensing of four vaccines prior to any safety testing for what the government calls a “novel flu virus with pandemic potential.” Although the government states that none of the vaccines contain adjuvants, that is manifestly untrue since the injected vaccines contain aluminum, a toxic adjuvant, and Novartis told the Natural Solutions Foundation on that same day that their approved vaccine contains MF59, their proprietary squalene adjuvant. The purpose of an adjuvant is to irritate the immune system into greater production of antibodies than it would otherwise create in response to a smaller antigen dose. Antigens are the most costly part of a vaccine to manufacture. Therefore, despite the enormous dangers, vaccine manufacturers are eager to use adjuvants.
Adjuvants like squalene (also known as MF59, ASO 1, 2, 3 and 4) are highly toxic unapproved drugs in the US. The Novartis (approved) Swine Flu and GSK (awaiting approval) vaccines contain 1 million times more oil in water adjuvant (read, “squalene”) than the devastatingly dangerous Vaccine A which caused the profound illness and death of so many previously healthy service men and women.
After you read the Complaint and the Brief and some documentation on the dangers of Squalene and similar adjuvants, it’s time to talk about what you can – what we believe we all must – do before the last second of the last minute of the now-past 11th hour has vanished and, with it, our ability to own and control the fate of our own bodies.

The headlines in this issue of the Health Freedom Action e Alert make it clear that Push Back is certainly working. Americans are not going to take it any more. Even most healthcare workers, including doctors, refuse to take voluntary vaccines and huge numbers of them are up in arms over the mandates which they are being faced with to either take the vaccines or lose their jobs! These are the folks in the know: they routinely do not take vaccines (less than 40% of the same pediatricians who harangue you to get your kids vaccinated follow the guidelines for their own vaccinations – they do not take them!) Less than 1/3 of all UK health care professionals will take the H1N1 shot. Australian doctors do not want to take it.
Less than 40% of parents in the US want their children vaccinated with the H1N1 vaccines!
The FDA and CDC folks are now engaged in a major public relations push to counter what they call myths, and what we call facts:
The H1N1 vaccine is untested, unsafe, unnecessary, uninsurable and unscientific. If you want it, fine. If not, it should be your right, under all circumstances, to refuse the vaccine without coercion or penalty. That’s what our lawsuit is about.

The same authorities who have warned us about the potential for pandemic for months now begin to change their tune, since it’s clear we don’t buy their obscurations and since we have (and we are!) independent sources of news, on the Internet, over Radio and the like, where people have learned not to trust authority.
“The World Health Organization, the UN agency (ir-) responsible for declaring a Phase 6 “PANDEMIC” global alert over what it calls H1N1 Influenza A or Swine Flu, whose chief Dr Margaret Chan has repeatedly warned that while Swine Flu to date had been rather mild, that the emergency declaration was necessary because it “could mutate” aggressively into a deadly pandemic killing millions, now admits well into the flu season in the Northern Hemisphere that H1N1 has apparently not mutated.”

So New York’s “emergency” flu vaccine mandates, and California’s and Pennsylvania’s and every other State’s, to say nothing of the absurd US Health Emergency declared just 11 days after the Swine Flu supposedly arose for the first time ever in Mexico, are based on no emergency at all. The Emperor has no clothes on and has no flu. When you have instructions like those in Mississippi’s emergency rooms that ALL respiratory illnesses are to be classified as Swine Flu and that there is not one laboratory in the entire state which can perform the lab tests (which are shockingly inaccurate) you know that you have a very naked Emperor, indeed!
It is important to remember that the HHS’s April 25th declaration of “emergency” with its language exculpating all government officials from the harm that may occur is based on no emergency; the imminent Emergency Use Authorization that FDA will use to permit the use of “adjuvants” (immune system toxins) that have never been permitted in drugs in the United States, because the government’s own scientists will not sign off on them, will be based on no emergency.

Big Pharma wants nano silver off the market. The EPA and FDA are ever compliant to the interests of Big Pharma and other mega industries, so their willingness to “regulate” (read, “eliminate”) nano silver is no surprise. Motion for “Stop the Shot” Injunction Filed in DC District Court
Washington DC – October 15, 2009: The Washington civil and regulatory rights law firm of Swankin and Turner filed a Motion in the United States District Court for the District of Columbia today, petitioning the Court for an Injunction to stop the distribution of the “Swine Flu” 2009-H1N21-A Vaccines approved by FDA on September 15, 2009 by voiding the licenses granted to the drug companies to sell the vaccines. The US government has purchased the entire supply of the four vaccines approved by the government and a contract distributor is currently distributing the live-virus nasal mist version to 90,000 pre-approved sites throughout the country.
The Motion was filed in the case of Null, Laibow et al. v FDA [USDC 1:09-cv-01924], in which Natural Solutions Foundation is a named Plaintiff, the plaintiffs allege that the approvals of these uninsurable, un-safety tested vaccines was “arbitrary and capricious” — violating the FDA’s own rules and the laws governing the approval of drugs. The Complaint in the case was filed on October 9, 2009
The emergency Motion for Injunction states in part,
The Defendants’ decision to issue the aforesaid licenses, modified licenses or approvals is arbitrary, capricious and contrary to law, and there is a substantial likelihood that Plaintiffs will succeed on the merits of this action. Specifically, the approvals violate the Food, Drug and Cosmetics Act (FDCA) and other statutes cited in Plaintiffs’ Brief, the Defendant Agencies’ implementing regulations and the Administrative Procedures Act show the following. … There is significant scientific agreement among independent scientists that the foreseeable risk of a vaccine’s potential to cause harm cannot be determined without adequate testing and that this is especially true regarding the 2009-H1N1-A Virus which has been arbitrarily and capriciously declared to be in a state of pandemic emergency. Further, Defendants have published a plan on their web sites to adulterate the approved vaccines with an unapproved “oil in water” adjuvant (squalene, a squalene derivative, and/or a squalene/GP120 mixture along with other as yet undisclosed and unlabeled components).

Among other relief, the order the plaintiffs are seeking provides:
…The issuance of an Emergency Use Authorization (EUA) referencing these inactivated-“novel A/H1N1”-influenza vaccines is stayed for Vaccines that permit the mixing of an adjuvant with a Vaccine outside of the Vaccine manufacturer’s Current-Good-Manufacturing-Practice-compliant facilities; and … Approval or use of these Vaccines be contingent upon clear restrictions mandating written fully informed consent and voluntary use, without coercion or risk of loss of liberty, right to health care choice, property, schooling, livelihood, licensure or other public good by any governmental entity.
Plaintiffs lawyers are seeking a hearing this coming week.

Washington DC – October 9, 2009: Despite the FDA’s intention to begin delivery this week of the n ovel “Swine Flu” 2009-H1N1-A live virus nasal mist vaccine to 90,000 government-approved locations nationwide, six New Yorkers and several NonGovernmental Organizations (NGOs) filed for an Emergency Injunction in the US District Court for the District of Columbia to prevent the distribution of what they believe are illegal, unnecessary and dangerous vaccines.
The case of Null, Laibow et al. v FDA et al. [Docket No. 1:09-cv-01924]challenges the legality of the September 15th licensing of four vaccines prior to any safety testing for what the government calls a “novel flu virus with pandemic potential.” The complaint alleges that the government failed to follow its own rules and applicable legislation in rushing the vaccine approvals in the absence of any of the requisite minimum scientifically sound and appropriate testing for both safety and effectiveness as required by law since 1964.

The New Yorkers are all health care workers who are therefore subject to that State’s new legal mandate (promulgated August 13, 2009) requiring that nearly all of the State’s half million health care workers receive all Federally recommended flu vaccines or lose their jobs. This requirement puts the health care workers in significant jeopardy since these newly approved vaccines have never been tested for either safety or efficacy and may carry major risks.
The lawsuit, announced at a demonstration by the health care workers last week at the State Capitol in Albany on September 29, 2009, is expected to be just one of the suits filed challenging various government “emergency” actions for a flu that has proven (during the just concluded Southern Hemisphere flu season) to be neither pandemic nor virulent despite dire predictions to the contrary and despite a Health Emergency declared by the CDC on April 25, 2009, 11 days after the first alleged death from Swine Flu on April 14, 2009 and a Level 6 Pandemic declaration by the World Health Organization followed on June 11, 2009 (which was only possible since W.H.O. downgraded the definition of a “Level 6 Pandemic”).
The Plaintiffs include health care professionals such as Dr. Gary Null, PhD, a well-known New York nutritionist, Rima E. Laibow, MD, a New York licensed physician who is Medical Director and a Trustee of the Natural Solutions Foundation, Dr. Tedd Koren DC, head of Foundation for Health Choice and four other health care workers covered by the mandate, including a Registered Nurse who has had prior adverse reactions to flu vaccines; a pregnant Nurse’s Aide, a health care student who has been told that she cannot see the patients whom she must see in order to finish her training, and a woman who works in the billing department of a hospital. All have been denied exemptions and told they will lose their positions under the new mandate if they are not vaccinated with all flu vaccines, including the new “Swine Flu” vaccine.
The Complaint alleges that the FDA erred in determining that safety testing was not needed because the 2009-H1N1-A vaccines are a mere “change of strain” not requiring safety testing. The Plaintiffs claim there is no significant scientific agreement that supports the government’s actions. The experts presented by the Plaintiffs include Sarah Schon MD, a Board Certified Immunologist and Paul G. King PhD, a noted analytical chemist with decades of experience in the pharmaceutical industry.
The Plaintiffs further allege that the Live Attenuated Influenza Virus (LAIV) nasal mist vaccine could trigger the very pandemic the government claims people should fear, calling the decision to allow a LAIV vaccine using a WHO and CDC declared “novel pandemic virus” an “arbitrary and capricious decision without any basis in the scientific record.”
Citing HHS Secretary Sebelius’s September 15th testimony before a Congressional committee when she announced the vaccine licensing, that even the FDA’s own scientists would not “sign-off” on the use of the most toxic vaccine ingredients (known as “oil in water adjuvants”) the Plaintiffs allege the government has a plan to nonetheless approve these substances, never before approved for drug use in the United States, under an “Emergency Use Authorization” (EUA) permitted by the 2005 Project Bioshield Act. On July 13, 2009, according to a press release on the www.HHS.gov web site, the government purchased nearly a half billion dollar’s worth ($485 Million USD) of the deadly adjuvnt squalene, an oil in water adjuvant, blamed by many nongovernmental physicians as a “Gulf War Syndrome” causative agent in more than 25% of the soldiers who were subjected to an experimental anthrax vaccine, Vaccine A, containing squalene. Vaccine A was later authorized under an EUA propmpting a Court ruling that makes its use legal only in voluntary situations. The government’s stockpile is enough squalene to “stretch” the 167 million doses of “Swine Flu” vaccine the government has purchased to cover the entire American population since the purpose of an adjuvant is to increase immune response to the injected material. The FDA web site indicates that the adjuvanted vaccines will be provided under an EUA which will allow the agency to skirt “Good Manufacturing Practices” and any issue of whether squalene is too dangerous to be permitted.
Secretary Sebelius further testified before Congress that a single company will be contracted by the government to deliver the vaccines to 90,000 locations around the country. The FDA site further indicates that the squalene will be mixed with the approved vaccines at those sites before administering the shots, without regard to normal pharmaceutical manufacturing requirements. The Plaintiffs claim that this will result in dangerously adulterated vaccines that may cause much more injury than the infamous 1976 “Swine Flu” vaccine program that killed hundreds and maimed thousands before it was stopped just ten weeks after it began, with nearly fifty million Americans having received that deadly shot or the dangerous squalene-adjuvanted Vaccine A which caused so many cataclysmic illnesses and deaths in Gulf War I military personnel. These shots, too, were both unnecessary and untested.
In their submitted Complaint, Brief and Certifications the Plaintiffs remind the Court that as early as 1905, even before the Federal authorities had the legal power to license vaccines, the Supreme Court stated, in Jacobson v Massachusetts (197 U.S. 11),
“We are not to be understood as holding … that the judiciary would not be competent to interfere and protect the health and life of the individual … ‘All laws,’ this court has said, ‘should receive a sensible construction. General terms should be so limited in their application as not to lead to injustice, oppression or absurd consequence.’ …”
The lead attorney for the Plaintiffs, Leslie Fourton JD, of New York, is working with the respected Washington regulatory law firm of Swankin and Turner and a team of legal experts from around the country, including Larry Becraft JD, Alabama, Alan G. Phillips JD, North Carolina, and Ralph Fucetola JD, New Jersey.
Counsel Fourton stated,
“Without taking into account serious objections raised by many scientists, FDA approved four “Swine Flu” 2009-H1N1-A Vaccines without enough concern about any definitive safety testing and the quality thereof. The Secretary of Health and Human Services testified before Congress, announcing the approvals and a program to widely distribute the Vaccines which were purchased by the federal government. The administrative record appears to be defective in that the record as posted on the Agency web site does not include, for all the approved Vaccines, a drug package insert or label with an accurate list of ingredients. We don’t know what was approved or how dangerous it may be. The Plaintiffs seek immediate relief.”
