Why Vaccine Injured Kids are Rarely Compensated

On Nov. 14, 1986, President Ronald Reagan signed the National Childhood Vaccine Injury Act of 1986 into law, instituting first-time vaccine safety reforms in the U.S. vaccination system and creating the first no-fault federal vaccine injury compensation program alternative to a lawsuit against vaccine manufacturers and pediatricians. Twenty-two years later, on Nov. 18, 2008, I made a statement to the Advisory Commission on Childhood Vaccines (ACCV) and questioned whether the compensation program is fatally flawed and so broken that it should be repealed. Many parents are wondering whether it would be better to return to civil court without restrictions to sue vaccine manufacturers and doctors for injuries and deaths their children suffered after receiving federally recommended vaccines.
During its two-decade history, two out of three individuals applying for federal vaccine injury compensation have been turned away empty-handed even though to date $1.8 billion has been awarded to more than 2,200 plaintiff’s out of some 12,000 who have applied. Today, nearly 5,000 vaccine injury claims are sitting in limbo because they represent children, who suffered brain and immune system dysfunction after vaccination but have been diagnosed with regressive autism, which is not recognized by the program as a compensable event. There is $2.7 billion sitting in the Trust Fund which could have been awarded to vaccine victims.
At the time of the law’s creation in 1986, Congress said they were committed to setting up a fair, expedited, non-adversarial, less traumatic, less expensive no-fault compensation mechanism alternative to civil litigation. But Congress also acknowledged that any legislation providing liability protection must also be equally committed to preventing vaccine harm. The Act contains strong safety provisions, including first-time mandates for doctors to record and report serious health problems, hospitalizations, injuries and deaths after vaccination and give parents written benefit and risk information before a child is vaccinated.
But few of the safety provisions have been enforced and, as I testified in Congress in 1999 and again at the Nov. 18 ACCV meeting, there has been a betrayal of the promise that was made to parents about how the compensation program would be implemented. Obtaining compensation has become a highly adversarial, time-consuming, traumatic and expensive process for families of vaccine injured children and far too many vaccine victims have been denied compensation while vaccine makers and doctors have enjoyed liability protection and dozens of doses of nine new vaccines have been added to the childhood vaccine schedule.
I pointed out that federal court judges are beginning to look back at the legislative history of the Act, which so clearly affirms the intent of Congress when creating it. In recent court decisions, judges have agreed with parents and their attorneys that the compensation program has become far too difficult for plaintiffs. A recent state Supreme Court ruling also reiterated that Congress never intended to shield vaccine manufacturers from ALL liability for vaccine injuries and deaths when it could be demonstrated that a safer product could have been marketed.
In a Supreme Court of Georgia ruling on October 6, 2008 in American Home Products v. Ferrari, the justices unanimously held that the National Childhood Vaccine Injury Act does not give a vaccine manufacturer blanket immunity from vaccine injury lawsuits if it can be proven that the company could have made a safer vaccine. Georgia Supreme Court Justice George Carley wrote that the 1986 law and “the congressional intent behind it shows that the Vaccine Act does not pre-empt all design defect claims.” He added that Congress did not “use language which indicates that use of the compensation system is mandatory” but only “an appealing alternative” to the courts.
Justice Carley wrote that there is no evidence that “FDA approval alone renders a vaccine unavoidably safe” and said “We hesitate to hold that a manufacturer is excused from making changes it knows will improve its product merely because an older, more dangerous version received FDA approval,” adding that to do so would have “the perverse effect” of granting complete immunity from liability to an entire industry and he concluded that “in the absence of any clear and manifest congressional purpose to achieve that result, we must reject such a far-reaching interpretation.”
During the ACCV meeting, longtime plaintiff’s attorney Sherry Drew gave a moving description of the suffering that families with vaccine injured children endure and, during public comment at the end of the meeting, Jim Moody, of SafeMinds, and Vicky Debold, RN, PhD joined me in urging the Committee to recommend to the new Secretary of DHHS that more vaccine injured children be compensated. This was echoed by outgoing parent ACCV member Tawny Buck, of Alaska, who has a DPT vaccine injured daughter and new ACCV parent member Sarah Hoiberg, of Florida, who has a DTaP vaccine injured daughter.
In the 1986 Vaccine Injury Act, the Institute of Medicine was directed to review the medical literature for scientific evidence that vaccines can cause injury and death, which resulted in landmark reports to Congress in 1991 and 1994 providing that evidence. IOM announced at the ACCV meeting that it has recently been contracted by the Health Resources & Services Administration (HRSA) to assemble a Committee of scientific experts to review of the medical literature for evidence regarding the biological mechanisms for injury and death in association with varicella zoster (chicken pox), hepatitis B, meningococcal and HPV vaccine. There will be several public workshops during the Committee’s two-year study.
NVIC has been calling for basic science research into the biological mechanisms of vaccine injury and death for more than two decades. Without understanding how and why vaccines can cause brain and immune system dysfunction, there will be no way to develop pathological profiles to help scientifically confirm whether or not an individual has been injured or died from vaccination.
The truth about vaccine risks lies in the science, properly designed and conducted. The upcoming IOM review may be hampered by a lack of biological mechanism studies published in the medical literature but the review is also an opportunity to point the way to fill in those gaps in knowledge and the need for additional research that could become part of a national vaccine safety research agenda.
In the absence of scientific certainty, all children who regress into poor health after vaccination should be given a fair hearing in the federal vaccine injury compensation program and generously compensated when no other plausible cause can be found for what happened to them after vaccination. Congress intended the vaccine injury compensation program to be non-adversarial, fair, generous and humane. If it cannot function the way it was intended to function, then parents have every right to call for its repeal and a return to unrestricted lawsuits.

Chronically ill Americans suffer far worse care than their counterparts in seven other industrial nations, according to a new study by the Commonwealth Fund, a New York-based foundation that has pioneered in international comparisons. It is the latest telling evidence that the dysfunctional American health care system badly needs reform.
The results of the study, published by the respected journal Health Affairs, belie the notion held by many American politicians that health care in this country is the best in the world. That may be true at a handful of pre-eminent medical centers, but it is hardly true for the care provided to a huge portion of the population.
The Commonwealth Fund’s survey of 7,500 patients in Australia, Canada, France, Germany, the Netherlands, New Zealand, Britain and the United States focused on patients who suffered from at least one of seven chronic conditions: hypertension, heart disease, diabetes, arthritis, lung problems, cancer or depression.
The care they received in this country – or more often did not receive – ought to be a cause for shame. More than half of the American patients went without care because of high out-of-pocket costs. They did not visit a doctor when sick, skipped a recommended test or treatment or failed to fill a prescription. The uninsured suffered most, but even 43 percent of those who had insurance all year skipped care because of costs.
Americans also were most likely to report wasting time because their care was so poorly organized. About a third reported that medical records and test results were not available when needed or that tests were duplicated unnecessarily. A third experienced a medical error, such as being given the wrong medication or test results. Some 40 percent found it very difficult to get after-hours care without going to an emergency room.
The United States did comparatively well in some areas, such as providing relatively prompt access to specialists and clear instructions to patients leaving the hospital. But the nation’s overall performance was abysmal.
By contrast, Dutch patients reported far more favorable experiences with their health care system, largely because the Netherlands provides universal coverage (through individual mandates and private health insurance), a strong primary care system and widespread use of electronic medical records. It should be possible to achieve the same level of performance here.

Fluoride is a multi-system poison. The Natural Solutions Foundation strongly opposes compulsory drugging through its addtion to the water systems of communities. We believe that this is both medically reckless and unconstitutional.
The Natural Solutions Foundation’s strongly anti-fluoride position for infants and children is now echoed by the American Dental Association (ADA) which says that children under 1 year should not be exposed to fluoride.
Although the US supported fluoride in infant formula during the 2006 Codex Committee on Nutritiona and Foods for Special Dietary Uses meeting in Chiang Mai, Thailand which dealt with infant formula and other special purpose foods, using data provided by the Natural Solutions Foundation, South Africa pushed the restriction on fluoride in healthy infants’ formula through, despite strong US objection.
Long a proponent of fluoridation of children’s teeth, the ADA joins the Natural Solutions Foundation in pointing out the dangers of the now-debunked toxin in infant’s bodies.
Rather than deal with the expense of safe disposal, the mining industry created the false belief that fluoride should be added to water, toothpaste, supplements, etc. That way, mining companies make a profit instead of taking a loss on fluoride which is expensive to dispose of according to EPA regulations. Despite propaganda to the contrary, fluoride has no known place in human metabolism and increases disease in those exposed to it. It is toxic to the brain, kidneys, bones, teeth, causes bone and other cancers at levels far lower than those permitted in water and has no known positive impact on human health despite oft-repeated but deeply flawed research claims to the contrary. Recent re-evaluation of the original research and other data make it clear that fluoride in any amount is a cumulative biological poison.
Although the United States has sought to add Fluoride to infant formula in the US and internationally, the World Health Organization recommends that infant formula be prepared in water which has no fluoride. Fluoridating water supplies means that infants will necessarily be exposed to amounts of fluoride which are toxic to them. “Little is known of the particular susceptibility of infants to fluoride but what we do know makes it clear that infant formula should be mixed with fluoride free water because fluoride is so toxic to them. Since infants are generally more sensitive to toxins than adults, banning it from formula is the only sensitive alternative,” according to Rima E. Despite its wide acceptance as a water and food additive, and even as a “nutritional supplement,” fluoride is actually a dangerous metabolic poison with permanent effects at levels much lower than 1 part per million (ppm). Exposure is cumulative since fluoride is a bio-accumulator which remains in the body and can cause cancer, kidney failure, bone disease, including bone cancers, structural damage to bone and teeth, thyroid poisoning, pineal gland calcification, reproductive failure, synergistic increases in lead poisoning when both are present, endocrine disruption leading to diabetes, other cancers and decreases in the availability of essential nutrients like magnesium.
In addition to water, the FDA allows sodium aluminum fluoride (cryolite) to be sprayed on more than 30 fruits and vegetables at up to 7 ppm. The USDA set a 1.2 ppm limit for arsenic and fluoride pesticides in 1933 since they are equally toxic. While arsenic sprays have been phased out, fluoride ones are increasingly popular and now can be used not only on food but on food storage areas as well. Current FDA water fluoridation standards allow up to 4 ppm and assure on-going fluoride contamination for most Americans.
Industry pressure is strong to increase the amount of fluoride we ingest: DOW Chemical uses extremely high fluoride tolerances on a wide number of common foods including 98 ppm for wheat germ, 40 ppm for wheat bran, 31 ppm for rice bran, 30 ppm for some nuts, 28 ppm for corn meal, 26 ppm for corn flour, 25 ppm for millet, wild rice, sorghum and wheat grains and 17 ppm for oat grain.
Leading scientists have called for a ban on all fluoride usage in light of its devastating impact on health and a recent evaluation of the data upon which fluoridation was initially approved by the FDA for municipal water supplies was deeply and fraudulently distorted when presented to the FDA and the public since toxic results were not revealed in the group receiving fluoridated water.
Vaccines often contain fluoride as an adjuvant or immune system irritant to provoke the immune system into producing more antibodies with fewer antigens since antigens are the expensive part of vaccines. Since vaccines also frequently contain aluminum hydroxide, the synergistic toxicity of the two toxins is significantly more than the toxicity of either toxic metal alone at the same dosage. This problem is repeated in municipal water supplies since fluoride is added for its alleged dental health benefits while aluminum salts are added to “polish” the water and give it an appealing gleaming appearance.
Fluoride as an additive has a dark past: it was first added to water in the Soviet Gulag (prison system) since it is a neurological poison and made political and other difficult prisoners complacent and therefore easier to manage. It was added to the water supplies of the Nazi death and slave labor camps for the same reason. Fluoride is widely used as an additive although the scientific evidence upon which its use rests is either fraudulent or flawed. Long a staple of water treatment, sodium fluoride has been replaced by other, even more toxic fluoride compounds like sulfuryl fluoride which has never been tested in water supplies nor approved for use in them.
The New York State Attorney General has expressed support for banning this dangerous but widely used pesticide. Fluoride contamination from either natural sources or its addition to liquids and products used by children results in dental fluorosis, a permanent mottling of teeth which is both cosmetic and structural, and similar structural damage to bone associated with increased fractures, osteoporosis (bone loss) and demineralization of bone. IQ loss and other neurological damage is due both to the fluoride itself and the dangerous interaction of fluoride with lead since fluoride renders lead even more toxic to the brain. Fluoride without lead leads to loss of higher cognitive functions including decision-making and IQ.

Citing price as the reason, Alaska authorities backed off requiring – and providing – Gardasil shots to young girls and women.
While it is possible to see this announcement as just another cost-cutting measure, the liklihood is that the serious controversy around this unnecessary, dangerous and ineffective vaccine which actually increases cervical cancer incidence in women by as much as 44.7% is the real cause for this back-off.
Whatever the reason, girls in Alaska whose families cannot pay for this shot are a great deal better off than girls whose families can afford it and do make the much hyped, but dangerous decision to give their daughters Gardasil.
Vaccination is so dangerous, despite the hype and hoopla which supports this very profitable segment of the pharmaceutical industry, that it is a totally uninsurable risk. That means that no insurance company will provide a policy to the manufactures to protect them from the liability law suits that they could be exposed to when their products cause harm.
Who will pay if Gardasil causes death and damage? Surely not Merck, Gardasil’s manufacturer. The FDA, the supposed “regulatory agency” which keeps dangerous products off the market, bowed to pressure and conflict of interest and rushed Gardasil through without adequate trials to establish even short term safety. And it has done something else. It has removed any threat of liability from any drug or vaccine manufacturer who causes harm through their product IF that product has been approved for any thing at all by the FDA.
So who will pay for the death and damage to otherwise healthy girls and women who died or were crippled in the immediate post-vaccination period? Who will pay for the cancers and deaths yet to come in a poorly tested vaccine which was rushed to market to make, literally, a killing without proper evaluation? Who will compensate women who cannot bear children as a consequence of this vaccination for the grief of their infertility, should that be one of the long-term effects of Gardasil injection? Who will pay for the injury to children and husbands who loose their mothers and wives prematurely if Gardasil is a long-term killer?
No one.

For the first time in more than 30 years, the State of Alaska will no longer offer all vaccinations free to all Alaska schoolchildren, the state Division of Epidemiology reported this week.
When the new policy begins on Jan. 1, two of the newest and most expensive vaccines — immunizations for girls to prevent cervical cancer and for both boys and girls to prevent meningitis — will only be offered free to low-income, uninsured or Alaska Native and American Indian children.
Other Alaskans will have to rely on health insurance policies to cover the expense, or pay for the vaccines themselves.
Federal funding of the state’s universal immunization program has failed to keep pace with the increasing cost and rising number of recommended vaccines, said Laurel Wood, manager of the Alaska Immunization Program.
For that reason, the state will cut back on two of more than a dozen vaccines it currently distributes to Alaska health care providers at no cost, including:
• Gardasil, the human papillomavirus (HPV) vaccine for girls, and
• Menactra, the meningococcal vaccine for boys and girls.
Under provisions of the federally funded Vaccines for Children program, both immunizations will continue to be offered free to young Alaskans who are Medicaid-eligible.
They will also be offered at federally funded health clinics (including the Anchorage Neighborhood Health Center) to “under-insured” children whose family policies don’t cover the cost of vaccines.
Fifteen older vaccines — including immunizations to protect children against hepatitis, diphtheria, polio, tetanus, measles, mumps, chickenpox and influenza — will continue to be offered free to all Alaskans under 18 years of age, regardless of income or insurance.

After the cutback, about 4,000 Alaska girls in need of the HPV vaccine and about 5,500 boys and girls in need of the meningococcal vaccine won’t be covered, Wood said.
The meningococcal vaccine costs the state $76 a dose, Wood said. The HPV vaccine — which requires three doses over a period of six months — costs about $300 per child for the complete series.
Trying to provide those vaccines at no cost to all Alaska school children would require an additional $1.6 million, Wood said.
The number of recommended vaccines has grown along with their costs, the Alaska Epidemiology Bulletin reported this week. In 2000 the entire battery of recommended vaccines cost $219 per child. Today the cost is $1,120 for boys and $1,429 for girls.
The cost of the HPV vaccine is the budget-buster.
Last year the state managed to cover that extra cost by tapping additional funds provided by the federal Centers for Disease Control and Prevention, Wood said. But that was a one-time fix.
“It was basically a disproportionate amount of money for the size of our population compared with other states,” Wood said.
Since the HPV vaccine was first made available in June 2007, the state has distributed 33,000 free doses to girls between 9 and 18 years of age, Wood said.
The vaccine is recommended for young women up to the age of 26, but it’s not mandatory to attend public schools.
The meningococcal vaccine was first made available in January, 2006. Since then the state has distributed about 36,000 free doses to boys and girls between 11 and 18 years of age,” Wood said.

Think about it for a moment: unlabeled GMOs with medical consequences, including, as in this case, sterility, constitutes the force feeding of industrial toxins to a global population. You might call it forced drugging, and you would be right.

Seven months ago we noted that a little-known genetic bioengineering firm in California, Epicyte, announced the development of genetically engineered corn which contained a spermicide which made the semen of men who ate it sterile in 2001. At the time Epicyte had a joint venture agreement to spread its technology with DuPont and Syngenta, two of the sponsors of the Svalbard Doomsday Seed Vault. Epicyte was since acquired by a North Carolina biotech company. It was astonishing to learn that Epicyte had developed its spermicidal GMO corn with research funds from the US Department of Agriculture, the same USDA which, despite worldwide opposition, continued to finance the development of Terminator technology, now held by Monsanto.
Every independent scientific review of safety of which I am aware documents the serious, potentially lethal, and now, sterility-inducing impact of these “foods”. One has to wonder whether the Epicyte human sterility gene is part of the NK 603xMon810 genome now since its impact is sterility.
Whether it is or not, what is clear is that the consumption of the unlabeled “foods” or their by products and derivatives poses as great a threat to humanity as the ever-promised Avian Flu Pandemic. Genetically Modified “foods” do not have names. They have numbers
Real food has names, usually less than 3 syllables. GMO “foods” and “feeds” hide behind initials and numbers like the biochemicals they are: e.g., NK 603 and Mon810. Those are genetically engineered corn types permitted for human and animal food in the US and the EU and elsewhere in the world. Neither corn (or “maize” as it is also called) has EVER been properly tested for safety by an independent governmental agency. No safety review of independent, non-industry studies has ever been done by a government agency anywhere in the world. Independent studies have never been commissioned by any government agency before these foods were approved, strictly on the basis of corporate assurances that these “foods” were safe in the US, Europe and elsewhere.
The reality is that when independent studies are conducted on these “foods”, they are neither safe nor benign.
The FDA thinks it is perfectly fine to take those rights, and your posterity, away from you without your knowledge or consent. By allowing genetically modified (GMO) “foods” which are known to reduce fertility in animals (we are, reproductively speaking, biologically similar to the animals being tested) and forbidding labeling of GMO foods or ingredients, the FDA says that foods like NK603 and Mon810 are acceptable to them. Is the truth that this is part of a long-stanidng, wide-ranging depopulation program using multiple ways to eliminate your ability to reproduce?
Who cares? You do, and so do we.

Genetically-engineered food: potential threat to fertility
Study shows that genetically engineered maize affects reproductive health in mice
Vienna, Austria, 11 November 2008 – A study published today by the Austrian government identified serious health threats of genetically engineered (GE) crops. In one of the very few long-term feeding studies ever conducted with GE crops, the fertility of mice fed with GE maize was found to be severely impaired, with fewer offspring being produced than by mice fed on natural crops. Considering the severity of the potential threat to human health and reproduction, Greenpeace is demanding a recall of all GE food and crops from the market, worldwide. Of course, that would mean changing the happy approval of Codex of all “foods” genetically modified and all GMO “feeds” as well. We’ll need your strong support to build the coalition to mass the muscle to reopen those issues. It can be done, of course, but we need your help.
Your only protection on your table and in your cupboards right now, of course, is to eat, grow and source organic food. Only organic food. Too expensive? What is your health worth and, if you are of child bearing age, the ability to have children or have your children have children? A few dollars more in food per week? Probably. If you can’t afford the expense, start doing intensive gardening in a corner of your apartment, on your patio or in a small corner of your garden. Foot Square Gardening references abound on the internet, at your library and in your book store. Take a look. Even in the winter it’s pretty simple to do indoors. Don’t delay, though. The damage from these Frankenfoods is cumulative.
The study, sponsored by the Austrian Ministries for Agriculture and Health, was presented today at a scientific seminar in Vienna, Austria. Prof. Dr. Jürgen Zentek, Professor for Veterinary Medicine at the University of Vienna and lead author of the study, summarised the findings: Mice fed with GE maize had less offspring in the third and fourth generations, and these difference were statistically significant. Mice fed with non-GE maize reproduced more efficiently. This effect can be attributed to the differences in the food source.
“GE food appears to be acting as a birth control agent, potentially leading to infertility – if this is not reason enough to close down the whole biotech industry once and for all, I am not sure what kind of disaster we are waiting for,†said Dr. Jan van Aken, GE expert at Greenpeace International. “Playing genetic roulette with our food crops is like playing Russian roulette with consumers and public healthâ€.
The Austrian scientists performed several long-term feeding trials with laboratory mice over a course of 20 weeks. One of the studies was a so-called reproductive assessment by continuous breeding (RACB) trial, in which the same parent generation gave birth to several litters of baby mice. The parents were fed either with a diet containing 33% of a GE maize variety (NK 603 x MON 810), or a closely related non-GE variety. A decrease in litter size and weight was found to be statistically significant in the third and fourth litters in the GE-fed mice compared to the control group.
Owned by Monsanto, the GE maize variety tested in this study is tolerant to a herbicide and resistant to certain insect pests. It has been approved for planting and food use in a variety of countries, including the US, Argentina, Japan, Philippines and South Africa. In Mexico and the European Union(1), it is approved for food and feed use.
“This study is yet another example that the food and feed safety of GE crops and food cannot be guaranteed. The reproductive toxicity of this GE maize was a totally unexpected result, but regulators around the world had considered this GE maize variety as safe as non-GE varieties – a potentially devastating error,†said Dr. van Aken.
