Congressional Hearing on FDA Lawlessness
Problem: FDA answers to its industrial constituency, not the Constitution and the well-being of the people of the United States.
Background: Article 16 of the enabling legislation which created what has become Food and Drug Administration in 1932 (who thought of combining foods and drugs?) says that the primary purpose of the Agency is to promote, protect and promulgate the Pharmaceutical Industry. The Agency is doing that job very, very well. Its other job, however, protecting the health and welfare of the American Public is not being served.
Summary: Despite Constitutional and explicit legal protection, the FDA has repeatedly created arbitrary, illogical and unlawful standards upon which to curtail First Amendment rights regarding health and food, nutrients, health devices and technologies and abused its considerable powers to stifle non-pharmaceutical, natural health options. FDA Marshals invade and terrorize small manufacturers of legal substances and devices. FDA lawyers bully and intimidate these same companies and individuals, jailing innocent people and destroying legitimate businesses which compete with drug company profits.

The FDA is a lawless, out-of-control agency terrorizing and killing Americans. We call on Congress to put a halt to this deadly reign of terror.
The Agency creates new standards never envisioned by Congress, approves deadly drugs, permits wildly dangerous food and contaminants and suppresses truthful, science-based information about health and food. In short, the FDA is conducting a war against freedom and the law.
Why is the Phase IV (drug/device approval) record of the FDA so dismal that approximately 50% of the drugs and devices which it approves for sale and use are withdrawn within 5 years due to deaths and other serious adverse events?
Why is the FDA not permitted to examine or conduct safety investigations on genetically modified foods and plants and animals modified to produce drugs?
Why does the FDA prohibit the accurate labeling of genetically modified foods, drugs, ingredients and products despite clear consumer demand for such labeling?
Why is the FDA unable to select experts for its Expert Panels who are free of professional and financial conflicts of interest? Without such freedom from conflicts of interest, the Expert Opinions upon which the FDA relies are dangerously self-interested?
Corruption in the Agency is nearly limitless: its scientists are routinely ignored and the decisions of its “experts” feather their own nests and harm the American public on a regular, daily basis.
So let’s ask Congress to use its investigative powers to hold investigative findings to end the reign of terror and corruption of the most lawless agency in the United States: the FDA, or, as it is tragically correctly called, the Fraud and Death Administration.
We set up an Action Item originally asking Congress to investigate the autism/mercury connection, but understand the issue is even broader than that tragic linkage. There is corruption at the very heart of the agency, corruption that cannot be cured by the best intentions.
Thus, we’ve modified that Action Item to petition Congress to redress our grievances against the lawless agency, an agency which Dr. Ron Paul has cited for “abuse of power…”

The questions we want Congress to ask the FDA include:
1. Is there any convincing evidence reviewed by FDA that the difference in autism incidence and prevalence between unvaccinated populations and vaccinated ones is NOT related to vaccination as the variable?
2. Is there any convincing evidence reviewed by FDA that sharp increases in autism incidence and prevalence is not related to the introduction of vaccines containing human fetal DNA?
3. Is there any convincing evidence reviewed by FDA that total body burden of mercury, from all sources (including vaccines, environmental contamination, dental amalgams, etc.) is not directly proportional to in utero and post partum neurological damage, including autism?
4. Is there any convincing epidemiological evidence reviewed by FDA that the exponential rise in the incidence and prevalence of autism in the last 40 years is not related to environmental toxicity, including vaccination contamination?
5. Is there any convincing evidence reviewed by FDA that a wide-spread genetic mutation has occurred in the last 40 years resulting in the exponential rise in incidence and prevalence of autism, supporting the assertion that autism is a genetic, not an environmental, disorder?
6. Is there any convincing evidence reviewed by FDA that psychotropic medication, much of which contains high levels of fluoride, is helpful in the long-term neurological and endocrine status of autistic persons and that these medications do not produce long term brain damage?
7. Is there any convincing evidence reviewed by FDA that autistic children do not benefit from natural medical therapies such as detoxification, chelation, enzymatic and dietary strategies?
8. Is there any convincing evidence reviewed by FDA that allopathically treated autistic persons have a better outcome than those receive natural remedies?
9. Is there any convincing evidence reviewed by FDA that the use of aluminum and other adjuvants, neurotransmitter analogues, formaldehyde, TWEEN 80 and other “inactive” ingredients in vaccines do not increase the incidence and prevalence of autism?
10. Is there any convincing evidence reviewed by FDA that vaccines prevent, mitigate or minimize infection with the diseases to which they are targeted or that they are safe when injected as formulated?
11. Upon what scientific basis does the FDA permit the fluoridation of water supplies, given the clear hazards of both sodium fluoride and hexafluoric acid, the type of fluoride most often used in municipal water supplies
12. Upon what scientific basis does the FDA permit the introduction of aluminum into municipal water supplies, given the known toxicity of aluminum to the central nervous system and the synergistic toxicity of aluminum and fluoride in the human body?
13. Upon what scientific basis does the CDC’s Advisory Committee on Imunization Practicies (ACIP) make its recommendatiions for child and adult vaccine schedules, given the deep conflicts of interest of its staff and experts?
14. Is the FDA, as an agency, hopelessly corrupt and in continual conflict of of interests with the drug industry? Is this agency, as charged by Dr. Ron Paul, engaged in “abuse of power?”
Further, in 1993 the FDA proclaimed its intention to “HARMonize” our nutrient and health freedoms to international restrictions. It continues to push this policy, rejected by Congress in the 1995 Anti-Harmonization Act. The FDA’s participation in such international agencies as Codex Alimentarius (the so-called World Food Code) is shameful, dishonorable, disgraces and damages the US around the world and contributes to the degredation of the food and health of not only the US but the entire world.

Here is what the WHO says is going on with the Pharmaceutical Industry, which they are, in fact, involved in up to their collective, corrupt eyeballs:
Just who is WHO. the World Health Organization?
WHO is the genocidal international bureaucracy (established under UN charter sections 57 and 63 which acts through private agreements with various interests) which declared a totally bogus “Pandemic”, telling countries not to bother testing for the H1N1 (Swine Flu) virus because everything was Swine flu, and there are no effective or accurate tests anyway.
WHO is the organization which, along with the Food and Agriculture Organization, runs and funds Codex Alimentarius, which, to quote WHO Under Secretary for Sustainability, Kirstin Leitner, “has failed to make a contribution to humanity in the [then] 43 years of its existence.” (CAC, Rome, July 4, 2005). I know she said that. I heard her because I was there, by the way, thanks to your generous support allowed General Bert and me to attend that meeting. There is another CAC coming up. It is interesting to note that Dr. Leitner’s candid comment was edited out of the original video of the session which then “mysteriously” became an audio track – far easier to edit, don’t you know!
It has been alleged that WHO gets more than two thirds of its funding from the pharmaceutical companies who make, among other things, vaccines. This appears to be done through private contracts and agreements that are intended to skirt WHO’s own rules.
WHO is the organization which recommended that Swine Flu vaccines be laced with squalene, which would, WHO scientists surely know, create both irreversible infertility and cataclysmic auto immune disease.
WHO is the organization which provided a genetically modified version of the otherwise not very dangerous H5N1 virus to Baxter which then, “just accidentally” contaminated 18 European countries’ seasonal flu vaccine supplies since they had a contract to provide the Avian Flu vaccines for any of those countries which developed Avian Flu!
WHO is the organization which we believe actually created both Swine Flu and Avian Flu in its Scottish research laboratory, going back to 1997 and before.
WHO is the supposed UN Agency (in the same way that the Federal Reserve is a US Agency – not at all) according to Wikipedia, which is “financed by contributions from member states and from donors. In recent years, the WHO’s work has involved more collaboration; there are currently around 80 such partnerships with NGOs and the pharmaceutical industry, as well as with foundations such as the Bill and Melinda Gates Foundation and the Rockefeller Foundation. Voluntary contributions to the WHO from national and local governments, foundations and NGOs, other UN organizations, and the private sector, now exceed that of assessed contributions (dues) from the 193 member nations.”[Emphasis added- REL]

Thus revealed in a small part of its corruption, the WHO turns the tables, creates a large lie by telling a little part of the truth, and puts out a report that says that we all have to be really, really careful about ….PHARMACEUTICAL AND GOVERNMENT CORRUPTION! Well, yes, of course we do, but the very existence of Big Pharma in its current violently abusive, dangerous, dictatorial and, yes, endlessly corrupt incarnation, has been achieved through the ceaseless service of the genocidal (in the interests, of course, of a “sustainable” world, of course) World Health Organization, among other corrupt and dangerous forces which it controls, including the US and other governments!
So We, the People of the world, have a wonderful opportunity here: dissolve the World Health Organization, which is set up to be the agency of the World Government as we have previously published documentary evidence to substantiate. If you recall, on June 7, 2007, the emergency powers of the WHO went into effect such that, should the be a Level 6 Pandemic (exactly as was needlessly declared last June 11, 2009), virtually every governance power devolves to the WHO. That’s right. For our own good, of course, for a sustainable planet from which we are absent because we were only, after all, Useless Eaters, and for a healthy planet in which contagion is properly controlled (never mind, of course, that this contagion was genetically engineered by this same WHO!) we are to be governed, injected, controlled and finally, exterminated. Let’s hear it for sustainability!
So what are we dealing with? We’ve got a lying, corrupt, dangerous and deceitful organization with terrifying powers and an avowed depopulation agenda. Why? And why is the United States in Codex at all? Why are we playing in their poisonous sand box?

WHO Issues Warning of Corruption of Pharmaceutical Industry

The World Health Organization (WHO) recently issued a fact sheet warning about
the corruption and unethical practices that are endemic to every step of the
pharmaceuticals business.
“Corruption in the pharmaceutical sector occurs throughout all stages of the
medicine chain, from research and development to dispensing and promotion,”
the fact sheet reads.
The medicine chain refers to each step involved in getting drugs into the
hands of patients, including drug creation, regulation, management and
consumption. According to WHO data, unethical practices such as bribery,
falsification of evidence, and mismanagement of conflicts of interest are
“common throughout the medicine chain.”
The fact sheet also highlights other forms of corruption specific to
particular steps in the chain. For example, clinical trials may be conducted
without proper regulatory approval, royalties may be collected through
manipulation or disregard of the patent system, and products may be registered
with incorrect or insufficient information.
Drugs may be produced through substandard or counterfeit methods, leading to
products that are less effective at best, and hazardous at worst. Corruption
can also occur during the drug inspection process, allowing such shoddy
products to be given a government seal of approval.
Once drugs have been produced for the market, corruption can occur via the
selection of non-essential drugs for different governments’ lists of
“essential” medications. Unethical marketing strategies — both legal and
illegal — are common throughout the drug business. Vendors may collaborate
with pharmaceutical companies and doctors might be unduly influenced to
dispense drugs to gain the greatest profit rather than to produce the greatest
benefit for the patient.
This corruption can have serious consequences, the WHO warns.
“Medicines are only beneficial when they are safe, of high quality, and
properly distributed and used by patients,” the fact sheet says.
Most obviously, corruption in the drug business can divert medicines away from
where they are most needed, while the production of substandard pharmaceutical
products can be dangerous to patients’ health.
“Diverted, counterfeit and substandard medicines have been identified in
markets of both rich and poor countries,” the fact sheet says.
“Such practices lead to patient suffering and have direct life or death
consequences.”
Corruption in the drug business also wastes public resources and “[erodes]
public and donor confidence in public institutions.” In Third World countries,
as much as 89 percent of health care spending is lost to corruption, while
unethical practices cost First World countries an estimated $12 billion to $23
billion a year. Worldwide, this amounts to a loss of 10 to 25 percent of all
drug procurement spending, or nearly $190 billion.
The WHO notes that corruption is so widespread in part because medicines pass
through a large number of intermediaries before they reach the patients who
need them. Each extra step provides an opportunity for corruption to take
place, ultimately driving up the cost of the medicine or diverting it toward
the wrong recipients.
Corruption is especially hard to fight because most cases go unreported. The
WHO attributes this both to fear of retaliation on the part of whistleblowers,
and also the institutionalization of corruption “to the point where people
feel powerless to influence change in their countries.”
According to the WHO, countries most likely to be plagued with corruption in
the pharmaceutical industry are those without “appropriate legislation or
regulation of medicines; enforcement mechanisms for laws, regulations and
administrative procedures; [or] conflict of interest management.”
“A lack of transparency and accountability within the medicines chain can also
contribute to unethical practices and corruption.”
Corruption has real health impacts, the fact sheet emphasizes. For example,
countries with more corruption have higher child mortality rates than other
countries with similar health standards.
As part of its efforts to reduce unethical practices in the medicines chain,
the WHO launched the Good Governance for Medicines program in 2004. This
program helps countries evaluate their vulnerability to corruption, then plan
and implement programs to reduce it.

Does Wall Street “Reform” Threaten DSHEA Products?
As most health freedom advocates know, the two most powerful “consumer protection” Federal agencies, the FDA and the FTC are not friendly toward natural products, including dietary supplements protected by the Dietary Supplement Health and Education Act of 1994 (DSHEA). Before that law, such products were under severe attack, so much so that FTC sought in 1975 to use its rule making power to effectively ban such products. By 1980 the public outcry caused Congress to restrict that power, and then in 1994 DSHEA was adopted, protecting our right to truthful information about nutrition.
Thus when a number of astute “old hands” in the industry said the new Wall Street “reform” * bill had language hidden in it that could threaten natural products with new general rule making power for the FTC to abuse.
We’ve opposed this bill on that basis, with many thousands of messages to Congress demanding protection in the bill for DSHEA products.

Now along come some suggesting there is no problem here (somewhat the way some “old hands” thought John McCain’s justly maligned and now happily defunct “Dietary Supplement Safety” bill, S.3002 was no threat). We’re told there is no FTC empowerment language. We did our due diligence and researched the actual bill, S.3217. Go to www.Thomas.gov and put in the bill number, open up the .pdf version and search for the name “Federal Trade Commission.”
You’ll find what I found:
I’ve reviewed the 1522 page .pdf file of the version of the bill considered by the US Senate. The terms “Federal Trade Commission” occurs on 26 pages. Five pages discuss FTC authority.

Page 1375 contains the smoking gun:
“(C) CONTINUATION OF CERTAIN COMMISSION AUTHORITIES. —
Notwithstanding subparagraphs (A) and (B), the Federal Trade Commission shall continue to have authority to enforce, and issue rules with respect to—
(i) the Credit Repair Organizations Act (15 U.S.C. 1679 et seq.);
(ii) section 5 of the Federal Trade Commission Act (15 U.S.C. 45) * and
(iii) the Telemarketing and Consumer Fraud and Abuse Prevention Act (155 U.S.C. 6101 et seq.).”
Section 45 of Title 15 states:
“Unfair methods of competition in or affecting commerce, and unfair or deceptive acts or practices in or affecting commerce, are hereby declared unlawful. ”
Notice how carefully the new law is stated, “continue to have authority to enforce, and issue rules…” — so it will “continue to have authority to enforce…” — notice carefully how it is worded, “…, and issue rules…” Thus “continue” applies to enforcing existing rules, dating from the 1970s or issued under limited laws passed by Congress (as they have done with regard to, for example, direct marketing) while “issue rules” is a new power which relates, tucked in section (ii) to the agency’s general Section 5 authority!
So FTC now has authority to enforce and issue rules with respect to “unfair or deceptive acts or practices in or affecting commerce…”
That is general authority to control all interstate commerce without further authorization from Congress!
I therefore conclude that the bill does threaten natural and DSHEA products.
One of my colleagues, Counsel Jim Turner of Swankin and Turner, Washington DC attorneys, puts it this way:
“My understanding is that the FTC was stripped of this authority in 1980 and this is an effort to restore that authority. It has broad implication for example if what I understand is true then this is the authority that FTC used in its effort to ban the words ‘organic, natural and health food’ from all commerce. It is not good if this is happening.”
Please continue to keep the pressure on Congress; we’ve revised the Action Item, telling our representatives that there is still time to get it right, in the conference committee that will shortly consider the bill.
